(A) The Animal Control Officer has the right to immediately seize and remove any feral cat found within the city for the following reasons:
(1) Public heath and safety concerns, including rabies, as identified by the Animal Control Officer or county’s Health Department; or
(2) Animals creating a public nuisance pursuant to § 91.020 of this chapter.
(B) The animal owner/caretaker shall be notified within 24 hours of the removal of any feral cat.
(C) Any cost incurred by the city as a result of a seizure pursuant this section shall be the sole responsibility of the owner/caretaker of the feral cat, or its colony.
