(A) (1) Pursuant to Section 111 of the International Property Maintenance Code (2006), a Board of Appeals is hereby established. The word "Board" when used in this regard shall be construed to mean the City Property Maintenance Code Board of Appeals.
(2) The Board shall consist of five members all of whom shall be approved by the City Council. Members shall be qualified by experience and training to pass on matters pertaining to property maintenance and who are not employees of the city. The City Code Enforcement Officer shall be an ex-officio non-voting member of the Board.
(B) Members shall reside within the corporate limits of the city and failure to maintain this residency requirement at any time shall subject him or her to immediate removal.
(C) (1) The term of office of the members of the Board shall be for five years; excepting that the membership of the first Board appointed shall serve respectively for terms of one member for one year, one member for two years, one member for three years, one member for four years and one member for five years. Thereafter, members shall be appointed for terms of five years each.
(2) Vacancies shall be filled for the unexpired term only. Members may be removed by the City Council at any time in its discretion.
(D) The Board shall annually select one of its members to serve as Chairman.
