9-1-4: TEMPORARY OCCUPANCY:
   A.   Permitted: Temporary occupancy may only be permitted if there are unfinished exterior items during the period of October 1 through March 30.
   B.   Requirements: An applicant requesting temporary occupancy prior to obtaining a final inspection for exterior items must comply with the following conditions:
      1.   Submit escrow to the city for completion, including materials and labor, of exterior items, the amount for which will be determined by the building inspector.
      2.   The contractor/homeowner must submit an escrow agreement from a loaning institution stating that funds totaling the determined escrow amount are being held by said institution for the purpose of finishing and obtaining a final inspection. The agreement must state that the amount will not be released without written authorization from the city and that all remaining funds are to be released to the city upon written demand after the expiration of the time granted if improvements have not been completed.
      3.   All items are to be completed by a reasonable date set by the building inspector, not to exceed one year.
      4.   If the items are not completed within the set time, the escrow amount, along with the completion fee, will be forfeited to the city. This forfeiture does not relieve the contractor or the homeowner from completing the improvements if for some reason the escrow amount is not sufficient to complete the improvements.
   C.   Penalty For Unauthorized Occupancy: If any person takes temporary or permanent occupancy prior to receiving written permission from the building inspector a fine of fifty dollars ($50.00) per day will be assessed. Water service will be terminated after forty eight (48) hours' notice is posted on the property. (Ord. 08-01, 1-8-2008)
