(a) The application for the permit to construct shall evidence on its face the following conditions:
(1) The construction of a link fence, or a fence of similar construction, around the entire pool;
(2) The fence for its entire length shall be of a minimum height of four feet;
(3) The fence shall be set back from the edge of the pool on all sides a minimum distance of four feet; and
(4) The fence shall have one gate and the latch to the gate shall be located at the upper extremity of the gate.
(b) A permit to construct shall be granted if the application meets the requirements set forth in subsection (a) hereof.
