After the expiration of the thirty days, as provided in Section 1014.02 the Police Department shall forthwith notify the Mayor who shall cause a letter to be sent to the owner of the property on which the excavation exists, such letter stating that the excavation shall be filled within ten days after receipt of the letter. In the event the property owner does not fill the excavation within ten days, the matter shall be submitted to Council. Council is hereby authorized to adopt a resolution naming the property owner and the location of the excavation, and directing the property owner to fill the excavation within ten days of service of the resolution upon the property owner by certified mail, such resolution to be mailed by the Fiscal Officer. In the event the excavation is not filled within ten days, the property owner shall be advised that the Village will come upon the property to fill the excavation, and any expenses incurred by the Village shall be certified to the County Auditor for inclusion on the property owner’s tax duplicate. Such expenses shall be deemed a lien on the property.
