412.06 TRAFFIC CONTROL AT WORK SITES.
   (a)   From the effective date of this section (Ordinance 1975-12, passed March 10, 1975) all contractors working within the Village, where their work, in the opinion of the Police Department, affects the movement of traffic, shall post police personnel at such contractor’s expense at such work sites during working hours. Such police personnel shall be int heir appropriate police uniforms and shall be at the work site at all times when a flagman is required. If more than one flagman is required, qualified police personnel shall man each post. Contractors shall notify the Police Department at least forty-eight hours before the commencement of any such work.
   (b)   Upon receipt of the notification set forth in subsection (a) hereof, the Police Department shall determine whether or not such work requires police personnel and shall notify the contractor of such determination. If, in the judgment of the Department, the situation requires police personnel for the safety of the traveling public, the Chief of Police may cause Village police personnel to maintain flag positions until proper personnel are supplied by the contractor or until the project is terminated. In the event that it is essential for Village police personnel to maintain flag positions, the contractor shall be responsible for financially maintaining such personnel.
   (c)   Any contractor violating any of the provisions of this section shall be subject to having his permit revoked, in addition to the penalty provided in Sections 408.01. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.

   (d)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
