§ 150.01 BUILDING CODE ADOPTED.
   (A)   The 2015 International Building Code, as amended and published by the International Code Council, is hereby adopted by reference as the Building Code of the village for the control of buildings and structures within the village and all of the regulations, provisions, conditions, and terms of the “2015 International Building Code,” excluding, however, the appendices contained therein, are hereby incorporated herein by reference, in haec verba, and adopted and made a part hereof, as if fully set out in this chapter.
   (B)   The foregoing notwithstanding, the following regulations shall supplement the “2015 International Building Code,” (“IBC”) in the event that the IBC is silent or incomplete or where the IBC is in conflict with the following:
      (1)   Minimum number of exits. There shall not be less than two independent exit ways at extreme ends of each independent dwelling on one-family and two-family dwellings.
      (2)   Emergency escape. Every sleeping room below the fourth story shall have at least one operable window approved for emergency egress or rescue. The units must be operable from the inside opening without the use of separate tools. Where windows are provided as a means of egress or rescue, they shall have a sill height not more than 44 inches above the floor. All egress or rescue windows from sleeping rooms must have a minimum net clear opening of 5.7 square feet. The minimum net clear opening height dimension shall be 24 inches. The minimum net clear opening width dimensions shall be 20 inches.
      (3)   Swimming pools. Swimming pools shall conform with the relevant provisions of the 2015 International Building Code. Every person owning land on which there is situated a swimming pool, which contains 18 inches or more of water in depth at any point, shall erect and maintain thereon a minimum of four feet in height fence completely surrounding all above or below ground level swimming pools by surrounding the property or pool area sufficient to make such body of water inaccessible to small children. Such enclosure, including gates therein, must not be less than four feet above the underlying ground or otherwise made inaccessible from the outside to small children.
      (4)   Minimum back yard. Every separate garage, auxiliary building, swimming pool or shed, both permanent or temporary, shall be placed no less than three feet from the rear alley boundary line.
      (5)   Fences. All fences six feet or less in height shall not require a building permit. All fences over six feet in height will require a building permit to be issued. All wood fences over six feet in height shall be required to be offset from the boundary lines by five feet from all side property boundary lines and five feet set back off the rear alley property boundary line. Any wooden fence constructed in a manner allowing light and ventilation to pass through it shall not be subject to the offset and setback requirements of this division.
