§ 32.32  FIRE PROTECTION SERVICE TO PROPERTIES OUTSIDE OF VILLAGE.
   (A)   The village is hereby authorized to enter into contracts with owners or occupants of commercial, industrial, residential, and farm property which lies outside the corporate limits of the village to furnish fire protection services, on the following terms and conditions.
      (1)   Those owners or occupants desiring fire protection service pursuant to this section shall pay by May 1 of each year an annual registration fee of $75.
      (2)   The entering into of such contracts for furnishing fire protection services shall not be mandatory on the part of the village, and each request for such services shall be considered individually and approved or denied for such reasons as may be deemed appropriate in the sole discretion of the village and its President, Trustees, employees, and agents.
      (3)   Under the terms of such contracts, the village shall not be obligated to service fires outside the village limits when to do such will unduly endanger property within the village limits and whether servicing a fire will unduly endanger said property shall be solely and exclusively in the discretion and judgment of the village and its President, Trustees, employees, and agents. At no time shall the village, for the purpose of fighting any one fire pursuant to the provisions of this section, supply more than one tanker, one pumper, and seven firefighters, it being understood that the number of firefighters present at the scene is always subject to their availability for firefighting service from day to day.
      (4)   The village is hereby authorized to negotiate for contracts to furnish fire protection services for other governmental agencies and major industrial plants outside the village limits upon such terms and conditions as may be mutually agreeable.
   (B)   There shall be paid to the village the sum of $500 for each fire call made by the Village Fire Department outside of the corporate limits, the same to be paid by those persons requesting or accepting such fire call service and the Village Clerk and Fire Department officers may adopt such rules and regulations with regard to providing information as to the improvements to be served and the location of them and with regard to securing payment of the foregoing charge as they may deem reasonable and proper under the circumstances and may require that proof of insurance affording coverage for such fire call service be filed with the Village Clerk as a prerequisite for furnishing such fire call service.
   (C)   The Fire Department of the village shall provide firefighting and fire protection services outside the village limits only to those owners or occupants who have registered with the village for such service and otherwise complied with the terms and provisions of this section.
   (D)   Services pursuant to this section shall commence on May 1, 1986 or as soon thereafter as the Fire Chief determines that the Department is prepared to render such services.
