§ 92.02 ABANDONED VEHICLES; GENERALLY.
   (A)   No person shall leave any vehicle at any place within the city for any time and under any circumstances that indicates abandonment. A vehicle left parked in any one place on the public right-of- way for a period of seven days or more, without having been moved a minimum of 50 feet within that span of time, shall be deemed abandoned, and subject to removal by the City Police Department, including towing at the owner’s expense.
   (B)   Junked vehicles are not permitted to be parked on the city public rights-of-way for any period of time. Junked vehicles parked on the city right-of-way shall be deemed abandoned and subject to immediate removal by the City Police Department, including towing at the owner’s expense. For the purpose of this section, a JUNKED VEHICLE is one which is inoperative or reasonably appears to be inoperative, wrecked, dismantled, partially dismantled, or discarded. Conditions which indicate that a vehicle is junked include, but are not limited to, extensive rust, or without all properly inflated tires, windshields or windows, major chassis components, brake lights, or without any other vehicle component required by law to operate safely on the streets, or with expired license plates or registration tags, or without a valid license plate or registration tag.
      (1)   A junked vehicle located on the public rights-of-way shall be deemed a public nuisance
      (2)   It shall be a parking violation for any person or persons to cause or allow a junked vehicle to be placed, located, maintained or to exist upon the public right-of-way.
      (3)   Any junked vehicle located on the public right-of-way is subject to being removed by the City Police Department, including towing at the owner’s expense.
   (C)   It shall be a parking violation to park or store upon a public right-of-way any vehicle which is not capable of being driven under its own power or which cannot be legally operated on public ways. Such vehicles shall be deemed abandoned and subject to immediate removal by the City Police Department, including towing at the owner’s expense.
   (D)   Vehicles which are parked on a public right-of-way but become temporarily inoperable while parked due to unforeseen circumstances such as a dead battery, or mechanical issues, or that are disabled by virtue of a collision while the vehicle is parked, or due to a temporary flat tire arising while the vehicle is parked, must be moved within three days of the event giving rise to the temporary incapacity. Failure to move the vehicle within that three days shall subject it to removal by the City Police Department, including, towing of the vehicle at the owner’s expense.
