(A) The owner of record of a motor vehicle impounded by the Village Police Department, pursuant to any state or federal law, shall be liable to the village for such administrative tow fees as provided herein.
(B) Any motor vehicle seized by the Village Police Department, pursuant to any state of federal law, shall not be released to the owner of record, or the owner’s authorized agent, without an administrative towing fee of $250 being paid to the village. Said administrative fee is in addition to all applicable towing and storage fees.
(C) If an individual tried for a violation of a state or federal law resulting in a motor vehicle’s impoundment receives a judgment of “not guilty” in a court of competent jurisdiction, said administrative fee shall be refunded to the owner of record. A disposition of court supervision is not a judgment of “not guilty”.
