(A) No sale shall be conducted unless and until the individual desiring to conduct the sale obtains a permit therefor from the Town Utility Billing and Collections Department. Prior to issuance of any sale permit, the individual desiring to conduct the sale shall file a written application with the Utility Billing and Collections Department at least 5 days in advance of the proposed sale, or, if mailed, application must be postmarked at least 7 days in advance of the sale, setting forth the following information:
(1) Full name and address of applicant;
(2) The location at which the proposed sale is to be held;
(3) The date or dates on which the sale shall be held;
(4) The date or dates of any other sales within the current calendar year; and
(5) An affirmative statement that property to be sold is owned by the applicant as his or her own personal property and was neither acquired nor consigned for the purpose of resale.
(B) Before issuing a permit, the Town Utility Billing and Collections Department shall determine that the application is in all respects proper, and that the applicant is qualified under this chapter for a permit.
(C) There shall be an administrative processing fee of $5 for the issuance of the permit. The permit shall set forth and restrict the time and location of the sale. No more than 2 permits may be issued to 1 resident or family household during the calendar year. If members of more than 1 residence join in requesting a permit, the permit shall be considered as having been issued for each and all of the residences.
