(A) Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
WATER WELL. A source of water either dug, bored, drilled, or driven into a water bearing formation utilized as a source of water supply.
(B) Water wells prohibited. No new, potable water well shall be constructed, reconstructed, installed or used within the following boundaries within the village: the Fox River to the east, Walnut Street to the west, Kane Street to the north, and Stone Street to the south, including Kane Street (the “Well Restricted Area”), the Well Restricted Area being legally described in Exhibit “A” attached to Ord. 2002-99. This prohibition within the Well Restricted Area expressly includes points of withdrawal by the village or by any other state certified public water supply. Outside the Well Restricted Area, no water well shall be constructed, reconstructed, or reconditioned within the corporate limits of the village for potable water except for existing state certified public water supply systems serving more than ten parcels of land. The repair or replacement of pumping equipment in existing wells shall be permitted. Existing wells may be used for non-potable commercial and/or industrial purposes.
(C) Abandonment of wells for potable water required. Upon connection to the village water system, any wells serving the property with potable water shall be abandoned, sealed, and inspected in accordance with Illinois ADM Title 77, § 920.120 and Illinois Department of Mines and Minerals Rule XI-A. Wells may be used in accordance with division (B) of this section.
(D) Well points. Any piping from a well point water source shall not be connected to any piping connected to a village water supply system.
