§ 51.27 LIABILITY OF THE PROPERTY OWNER.
   (A)   The village shall not be liable for any damage caused by a leak or break in any service pipe.
   (B)   The village will not replace or repair a water meter installed in a water service that is in an unacceptable condition, until such time as the water service is repaired and is acceptable to the village.
   (C)   The property owner shall be responsible for any damage to all buildings, trees, or other obstructions within village easements that may result from work being performed in/on the easements.
   (D)   If a leak should develop in the water service connection while performing work on a water service extension, it shall be the responsibility of the person causing the leak to repair the item at their own expense.
   (E)   If a leak should develop on the domestic side of the curb stop/B box, including the flare nut, the repair shall be made at the expense of the property owner.
   (F)   The property owner shall be responsible for damage to a water meter, such as damage to the meter housing, frost plate, register, remote reader and wire. Damage includes, but is not limited to, neglect, carelessness, willful destruction, vandalism, freezing, or any other circumstance which would cause the meter to malfunction, other than a faulty meter. All repairs to the water meter shall be on a “parts and labor” basis, and charged to the property owner according to rates established in §§ 150.45 et seq. of this code, and which rates may be changed and amended from time to time by the Director of Public Works of this village.
