§ 91.72 DISPOSAL AND REMOVAL BY VILLAGE DUE TO LANDLORD/OWNER FAILURE TO DISPOSE PROPERTY.
   If any landlord, owner or agent of the same, not including an officer of the Kane County Sheriff’s Office executing the eviction, fails to dispose and remove property in the manner set forth in this chapter, the village is hereby authorized to have such property removed and disposed. In the event the village removes or disposes of such property, the village may collect from the owners the village’s actual cost of disposal, plus an amount equal to $50 to cover the village’s administrative costs and expenses. Such charges shall be paid by the property owner upon notification by the village. If the owner refuses to pay the village within 14 days of the notification, the village may file a lien upon the real estate upon which the property was removed with the Kane County Recorder of Deeds.
