§ 111.31 CLASS “A” LICENSES.
   (A)   Class "A" licenses shall authorize the retail sale of alcoholic liquor in original packages only and not for consumption on the premises. The hours of sale of alcoholic beverages shall be not greater than Sunday - Saturday, 7:00 a.m. to 12:00 a.m.
      (1)   Class "A-1".
         (a)   Class "A-1" licenses shall authorize the retail sale of alcoholic liquor in original packages only and not for consumption on the premises. The primary purpose of the premises shall be the retail sale of alcoholic liquor (liquor store). No entrance or exit other than for employees shall lead from any other building or portion of building to the area in which alcoholic liquor and incidentals thereto shall be sold by a Class "A-1" license holder
         (b)   There is an annual fee of $1,500 for a Class "A-1" license. There shall be five "Class A-1" licenses.
      (2)   Class "A-2".
         (a)   Class "A-2" licenses shall authorize the retail sale of alcoholic liquors in original packages only and not for consumption on the premises. The primary purpose of the premises shall be for retail sales other than the retail sales of alcoholic liquor, such as a food store, drug store or mass merchandiser. The premises shall have 10% or less of the gross retail square footage devoted to the retail sale of alcoholic liquor. The application for a Class "A-2" license shall be accompanied with a floor plan accurately depicting the premises.
         (b)   There is an annual fee of $1,600 for a Class "A-2" license. There shall be six Class "A-2" licenses.
      (3)   Class "A-3".
         (a)   Class "A-3" licenses shall authorize the retail sale of beer and wine in original packages only and not for consumption on the premises. The primary purpose of the premises shall be for the retail sales of gasoline, such as gas stations or truck stops. The premises shall have 10% or less of the gross retail square footage (including coolers) devoted to the retail sale of beer and wine. The application for a Class "A-3" license shall be accompanied with a floor plan of the premises accurately depicting the manner in which the beer and wine will be displayed. Beer in containers of 16 ounces or less shall not be sold to any person in quantities of less than four cans or bottles for consumption.
         (b)   There is an annual fee of $1,500 for a Class "A-3" license. There shall be seven Class "A-3" licenses.
      (4)   Class “A-4". A class "A-4" license shall authorize the retail sale of alcoholic liquor in packages and the consumption on the premises in locations where a grocery store is the primary business. Curb service or sale is prohibited. The annual license fee for such license shall be $3,500. There shall be one Class "A-4" licenses. Class "A-4" licenses may sell alcoholic liquors from 10:00 am to 10:00 pm seven days a week for on-premises consumption and 7:00 a.m. to midnight seven days a week for off-premises consumption.
         (a)   The sale of alcoholic liquor, in original packages, unopened only, shall be permitted subject to the following conditions:
            1.   Free tastings, classes or seminars shall be permitted on such premises in accordance with state law.
            2.   Alcohol sold in original packages and intended for off-premise consumption shall not be opened or consumed on the premises or in any designated seating/serving area.
         (b)   The sale of alcoholic liquor shall also be permitted for consumption on the premises subject to the following conditions:
            1.   The premises shall exceed 15,000 square feet.
            2.   The seating/serving area for customers consuming alcohol on the premises shall not exceed 20% of the retail square footage area of the premises or 3,000 square feet, whichever is less.
            3.   Consumption of alcoholic liquor on the premises shall be limited to the designated seating/serving area and signage shall be posted that patrons may not leave the area with open alcohol.
            4.   Such premises shall include an area where food is prepared and regularly served, including hot or cold sandwiches, appetizers, tapas, baked goods or other similar foods.
            5.   It is intended that the service of alcoholic liquor is merely an adjunct to the operation of a grocery store and shall not be advertised or otherwise held out to be a drinking establishment.
   (B)   A holder of a Class "A-1" or "A-2" license may obtain one of the following two tasting permits to conduct tastings as a promotional procedure. No tasting event shall take place outdoors.
      (1)   Type 1 tasting permit. A permit to conduct a tasting once a month for a period not to exceed three consecutive days. This Type 1 tasting permit is subject to an annual fee of $200 in addition to the prescribed Class "A" license fee, except that no licensee shall give or offer to give away alcoholic liquors as a gift, gratuity, or tie-in with the sale of nonalcoholic products or to induce the purchase of or promote the sale of nonalcoholic products. Liquor tastings under this division shall be limited to beer, wines and liqueurs only and shall be limited to the approved liquor display area. A "tasting" is limited to two ounces or less of a particular alcoholic beverage served to the same patron.
      (2)   Type 2 tasting permit. A permit to conduct a tasting once a week for a period not to exceed two consecutive days. The Type 2 permit is subject to an annual fee of $400 in addition to the prescribed Class "A" license fee, except that no licensee shall give or offer to give away alcoholic liquors as a gift, gratuity, or tie-in with the sale of nonalcoholic products, or to induce the purchase of or promote the sale of nonalcoholic products. Liquor tastings under this division shall be limited to beer, wines and liqueurs only and shall be limited to the approved liquor display area. A "tasting" is limited to two ounces or less of a particular alcoholic beverage served to the same patron.
