The following rules and regulations shall be compiled and displayed at the office of the Village Clerk in pamphlet form during all regular business hours:
(A) The Freedom of Information Act, ILCS Ch. 5, Act 140, §§ 1 et seq., took effect in the State of Illinois on July 1, 1984.
(B) Requests for information in the Village of South Elgin shall be made in writing to the Village Freedom of Information Officer, at the Village Hall, 10 North Water Street, South Elgin, Illinois, 60177 (phone: (847) 742-5780).
(C) Requests for information shall be in written form to the FOIA Officer. All requests shall be decided upon within the times set forth in the Act. Requests in written electronic form (such as e-mail) are permitted under the Act provided they are directed to the FOIA Officer through the appropriate portal. The Village Clerk shall cause information to be present on the village’s electronic media directing the public to the appropriate portal.
(D) All responses, denials and appeals shall be as per the terms of the Act.
(E) Requests generating a response in excess of 50 pages will be provided in electronic format (CD or other portable storage device) and the cost will be per the Act and according to the schedule of charges maintained in the Clerk's office. Where the Act permits the village to charge a fee for the cost of copying records, the fee shall be $0.15 per page, unless special services, such as color copying or oversized copying, are required in which such case the cost shall be the actual cost of reproduction. A copy of the Act, and of the village’s rules and regulations, is available for examination at the Village Hall upon request.
(F) Commercial request(s) may be subject to additional fees as provided in the Act. Where the Act permits, the village will charge $10 for each hour spent by village personnel searching for and retrieving records in response to a commercial request. No fee shall be charged for the first eight hours spent by personnel in searching for or retrieving a requested record. Commercial requests may also be charged the actual cost of retrieving and transporting public records from an off-site storage facility when the public records are maintained by a third-party storage company under contract with the public body.
