§ 10.03 DEFINITIONS.
   For the purpose of this code, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AND or OR. The word AND may be read as OR and OR may be read as AND where the sense requires it.
   BOND. When a bond is required, an undertaking in writing shall be sufficient.
   CLERK. The employee designated to perform the functions of Town Clerk pursuant to state law.
   COMPUTATION OF TIME. The time within which an act is to be done shall be computed by excluding the first day and including the last, and if the last day be a Sunday or a legal holiday, that shall be excluded.
   CORPORATE LIMITS or CORPORATION LIMITS or TOWN LIMITS. The legal boundary of the Town of South Congaree.
   COUNCIL or TOWN COUNCIL. The Town Council of the Town of South Congaree, South Carolina.
   COUNTY. The County of Lexington in the State of South Carolina.
   DELEGATION OF AUTHORITY. Whenever a provision appears requiring the head of a department to do some act or make certain inspections, it is to be construed to authorize subordinates to perform the required act or make the required inspection unless the terms of the provision or section designate otherwise.
   GENDER. Words importing the masculine gender shall include the feminine and neuter.
   INTERPRETATION. In the interpretation and application of any provision of this code, it is held to be the minimum requirements adopted for the promotion of the public health, safety, comfort, convenience and general welfare. Where any provision of this code imposes greater restrictions upon the subject matter than the general provision imposed by this code, the provision imposing the greater restriction or regulation shall be deemed to be controlling.
   JOINT AUTHORITY. All words giving a JOINT AUTHORITY to three (3) or more persons or offices shall be construed as to giving the authority to a majority of the persons or officers.
   KEEPER AND PROPRIETOR. Include persons, firms, associations, corporations, clubs and partnerships, whether acting by themselves or through a servant, agent or employee.
   MAYOR. The Mayor of the Town of South Congaree.
   MONTH. A calendar month.
   MUNICIPALITY. The Town of South Congaree.
   NAME OF OFFICER. Whenever the name of an officer is given it shall be construed as though the words “of the Town of South Congaree” were added.
   NONTECHNICAL AND TECHNICAL WORDS. Words and phrases are construed according to the common and approved usage of the language; but TECHNICAL WORDS and phrases and others as may have acquired a peculiar and appropriate meaning in law shall be construed and understood according to such meaning.
   NUMBER. Words used in the singular number include the plural and the plural shall include the singular number.
   OATH, SWEAR, SWORN. The word OATH shall be construed to include an affirmation in all cases in which, by law, an affirmation may be substituted for an OATH, and in such cases, the words SWEAR and SWORN shall be equivalent to the words AFFIRM and AFFIRMED.
   OFFICERS, AGENTS, THINGS AND PLACES OF THE TOWN. Unless a contrary intention appears, the officer, agents, employees and other persons, things and places situated in the town or employed by or appertaining to the town or subject to the jurisdiction thereof.
   OWNER. Applied to a building or land shall include any part owner, joint owner, tenant in common, joint tenant or tenant by the entirety, of the whole or part of the building or land.
   PERSON. A corporation, firm, partnership, association, organization and any other group acting as a unit, as well as an individual.
   PERSONAL PROPERTY. Includes every species of property, except real property, as defined in this section.
   PRECEDING, FOLLOWING. Next before and next after, respectively.
   PREMISES. Place or places.
   PROPERTY. Real and personal property.
   PUBLIC PLACE. Any park, cemetery, schoolyard or open space adjacent thereto.
   REAL PROPERTY and REAL ESTATE. Land, tenements and hereditament.
   RESIDENCE. The place adopted by a person as his or her place of habitation, and to which, whenever he or she is absent, he or she has the intention of returning. When a person eats at one (1) place and sleeps at another, the place where the person sleeps shall be deemed his or her residence.
   ROADWAY. The portion of a street improved, designed or ordinarily used for vehicular traffic.
   SEAL. The town or corporate seal.
   SIDEWALK. Any portion of a street between the curb line, or the lateral line of a roadway where there is no curb, and the adjacent property line intended for pedestrian use.
   SIGNATURE or SUBSCRIPTION. Includes a mark when the person cannot write.
   STATE. The State of South Carolina.
   STREET. Avenues, boulevards, highways, roads, alleys, lanes, viaducts, bridges and approaches thereto and all other public thoroughfares in the town, and shall mean the entire width thereof between opposed abutting property lines. It shall be construed to include a sidewalk or foot path, unless the contrary is expressed or unless the construction would be inconsistent with the manifest intent of the Town Council.
   TENANT or OCCUPANT. Applied to a building or land, shall include any person who occupies the whole or part of the building or land, whether alone or with others.
   TIME. Words used in the past or present tense include the future as well as the past and present.
   TOWN, CITY, CORPORATION. The Town of South Congaree in the County of Lexington and the State of South Carolina, except as otherwise provided.
   WRITING. Printing and any other mode of representing words and letters.
   YEAR. A calendar year.
