11-1-3: DEFINITIONS:
When used in this Title, the following words and terms shall have the meanings ascribed to them in this Section:
ACCEPTED PUBLIC STREET: Any street duly accepted by the Village Board of Trustees for maintenance by said Village.
ALLEY: A public right of way, not less than twenty feet (20') nor more than forty feet (40') wide, designed to provide access to the rear or side of properties whose principal frontage is on some other street.
APPROVED STREET: Any street, whether public or private, meeting standards and specifications of the Village.
BOARD OF TRUSTEES: The duly elected Trustees and President of the Village of South Barrington who, together, constitute the official governing body of the Village.
BUILDING LINE: A line within a lot or other parcel of land, so designated on the plat of the proposed subdivision.
BUILDING LINE SETBACK: The distance between the building line and the street line in a district, lot, tract or parcel of land.
COLLECTOR or SECONDARY STREETS: Those existing streets designated as such on the Official Plan of the Village, and those streets proposed as collector streets in new subdivisions, as shown on the Official Plan, for the purpose of providing arteries for the access of traffic from several minor streets to a major street. Right of way for such streets shall be not less than sixty six feet (66') nor more than eighty feet (80').
COMMISSION: Refers to the Plan Commission/Zoning Board of Appeals of the Village. 1
COMPREHENSIVE PLAN The Official Plan of the Village, prepared by the Plan Commission/Zoning Board of Appeals and adopted by the Board of Trustees. 2
CROSSWALKWAYS: A strip of land dedicated to public use and located across a block to provide pedestrian access to adjacent areas.
CUL-DE-SAC: A street accessible from only one direction whose terminal end is broadened into a circular vehicle turn-around.
DEDICATED STREET: A public right of way owned by the Village and created by designation on a recorded plat of subdivision or in a recorded instrument accepted by the corporate authorities of the Village.
DEVELOPER: Any person, group of persons, organizations, etc., whose primary concern and desire is to subdivide and improve land according to this Title.
EASEMENT: A grant by a property owner for the use of a strip of land by the general public, a corporation or a certain person or persons for a specific purpose or purposes.
FINAL PLAT: The drawings and documents described in Chapter 2 of this Title.
FLOOD PLAIN: The contiguous area adjacent to a lake, stream, stream bed, ditch, swale or any watercourse, the elevation of which is greater than the normal water level or pool elevation but equal to or lower than the flood crest elevation.
FRONTAGE: The length of the front property line of the lot, lots, or tract of land abutting a street, road or highway.
GENERAL DEVELOPMENT PLAN: That part of the Official Comprehensive Plan of the Village which defines the various zoning areas and the existing or proposed primary and secondary streets and roads in and around the Village.
GRADE: The slope of a road, street or other public way, given as a percent and shown on street profile plans as required herein.
GRADE LANDING: The grade required on streets entering major thoroughfares, at the point of intersection, as required herein.
IMPROVEMENT, PUBLIC: Any sanitary or storm sewer, drainage ditch, water main, roadway, parkway, sidewalk, pedestrian way, planting strip, off-street parking area or other facility for which the Village or some other public body will assume the responsibility for maintenance and operation.
LOT: A portion of a subdivision or other parcel of land intended for transfer of ownership or for building development.
MAJOR STREET: See "Primary Street".
MINOR STREET: A street intended primarily as access to abutting properties.
OWNER: Any person, group of persons, firm or firms, corporation or corporations, or any other legal entity having legal title to the land sought to be subdivided under this Title.
PARKWAY: That part of the street right of way not occupied by the street pavement.
PEDESTRIAN WAY: A right of way across or within a block for use by pedestrian traffic, whether designated as a pedestrian way, crosswalk or however otherwise designated.
PLAN COMMISSION/ZONING BOARD OF APPEALS: See "Commission".
PLAT: A map, drawing or chart on which the subdividers plan of the subdivision presented and which he submits for approval and intends to record in final form.
PRELIMINARY PLAN: The drawings and documents described in subsection 11-2-1B, first submitted, of the proposed subdivision and subject to change and corrections.
PRIMARY STREET: Primary or major street means a street of considerable continuity which serves or is intended to serve as a major traffic artery between the various sections of the Barrington area, as shown on the Comprehensive Plan Map, or the Village Street Map.
PRIVATE IMPROVEMENT: Any installed or constructed facility for which the responsibility of maintenance and ownership will be retained by the owner or a homeowners' association.
PRIVATE STREET: Any road generally within a development that is used for access and circulation and the ownership and maintenance responsibility is borne by the owner, developer or homeowners' association.
PUBLIC IMPROVEMENT: Any facility for which the Village or other governmental body may ultimately assume the responsibility for maintenance and operation or which is constructed for general public use and benefit.
PUBLIC STREET: All primary, secondary and minor streets which are shown on the subdivision plat and are to be dedicated for public use, whereas the ownership and maintenance responsibility is generally borne by the Village.
RIGHT OF WAY: A strip of land occupied or intended to be occupied by a road, crosswalk, railroad, electric transmission lines, oil or gas pipeline, water main, sanitary or storm sewer main, or for other special use. Right of way shall be exclusive of the lots; adjoining lots or parcels and the dimensions of the right of way shall not be included in the adjoining lots or parcels. Right of way intended for roads or any other public use which will ultimately require maintenance by the Village or some other public body shall be dedicated to public use by the maker of the plat which establishes the right of way.
ROADWAY: That portion of a street which is paved or prepared for vehicular traffic.
SEWAGE DISPOSAL SYSTEM - CENTRAL: A system of sanitary sewers that discharges into an interceptor sewer or an approved sewage treatment plant.
SEWAGE DISPOSAL SYSTEM - INDIVIDUAL: A septic tank - seepage field sewage disposal system, or any other sewage treatment device approved by the Village serving only one lot or building site.
STANDARD SPECIFICATIONS: Refers to the "Standard Specifications for Road and Bridge Construction, State of Illinois, Department of Transportation", current edition, as well as 'Water and Sewer Main Construction in Illinois", current edition.
STREET: Refers to the entire width of the street right of way or easement and shall not be considered as the width of the pavement only.
SUBDIVIDER: Any persons, firms or corporations, partnerships, trusts or other legal entities who undertake the subdivision of land as defined herein.
SUBDIVISION: A described tract of land which is to be, or has been, divided into two (2) or more lots or parcels. The term "subdivision" includes resubdivisions and where it is appropriate to the context, relates to the process of subdividing or to the land subdivided.
   A.   For the purpose of these regulations, a single-family residential subdivision of land is, or includes:
      1.   The division of land for single-family residential purposes into one or more additional tracts, sites, or parcels of five (5) acres or less in area.
      2.   The division of land for single-family residential purposes into tracts of more than five (5) acres where the proposed lot frontage is less than five hundred feet (500').
      3.   The dedication or establishment of a public or private road, highway or street through a tract of land regardless of area.
      4.   Any sale or division of land for which a plat is required by statute; any resubdivision of land heretofore divided or platted.
   B.   Any multiple-family, commercial or industrial district included in a zoning district of the Zoning Title of this Code 3 after the effective date hereof, shall be considered as a planned development and shall be deemed a subdivision for the purpose of these regulations regardless of whether the land is divided into parcels for separate sale or is developed on a lease basis, and said subdivision shall be subject to the improvement and design requirements of this Title.
THROUGH LOT: Any lot having frontage on two (2) approximately parallel streets. Such lots are not permitted. 4
VILLAGE: The Village of South Barrington.
VILLAGE ENGINEER: An administrative officer appointed by the Village Board to perform such functions as outlined in this Title as well as the various ordinances of the Village as may be appropriate. The Board of Trustees may appoint a Superintendent of Public Works who shall be superior in authority to the Village Engineer and an Assistant Superintendent of Public Works who shall be authorized to perform certain or all functions assigned to the Superintendent of Public Works.
