8-7-19: PENALTY:
In lieu of or in addition to a stop work order and suspension of a permit, the plumbing inspector may instead issue a citation for the levy of a fine on the permittee. The fine imposed shall not exceed seven hundred fifty dollars ($750.00) for each violation. Each day on which a violation continues shall constitute a separate violation.
   A.   No such permittee shall be fined except after a public hearing by the village president or his designee, with a minimum seven (7) day written notice to the permittee, affording the permittee an opportunity to appear and defend against the charges contained in such notice. For purposes of this section, the notice period shall begin the day following delivery of the notice of hearing by certified mail or by personal service.
   B.   If the village president or his designee determines after such hearing that the permittee should be fined, a written order stating the reason for such determination and the amount of the fine, shall be entered, and a copy of such order shall be served upon the permittee at or after the hearing.
   C.   In addition to any fine or suspension, any permittee determined to have violated any of the provisions of this chapter shall reimburse the village for the costs of the hearing on such violation. The village president shall determine the costs incurred by the village for said hearing, including, but not limited to, court reporter fees, the costs of transcripts or records, attorney fees, the cost of preparing and mailing notices and orders and all other miscellaneous expenses incurred by the village or such lesser sum as the village president may allow.
   D.   The permittee shall pay said fines and costs to the general corporate fund of the village within thirty (30) days of the entry of said written order. Failure to pay said fines and costs within thirty (30) days of the entry of such written order shall constitute an additional violation of this chapter and may be cause for permit suspension or revocation, or the levy of an additional fine.
