Noise emanating from construction and maintenance activities shall be limited in time and location as hereinafter provided.
A. Definition: For the purposes of this section, "construction and maintenance activity" shall mean any work upon any building, structure, land or appurtenance thereto which shall be undertaken with or without the assistance of machinery or equipment, including, but not limited to, new construction of any building or structure, remodeling or reconstruction of an existing building or structure, application of trades including, but not limited to, masonry, electrical, plumbing, roofing, and carpentry, installation of above or under ground infrastructure, transportation of materials for construction and/or maintenance activities. B. Time: No commercial or noncommercial construction and maintenance activities shall be permitted except:
1. Monday through Friday from seven o'clock (7:00) A.M. to seven o'clock (7:00) P.M.
2. Saturday from eight o'clock (8:00) A.M. to seven o'clock (7:00) P.M.
3. Sunday, homeowner performed maintenance only, from ten o'clock (10:00) A.M. to seven o'clock (7:00) P.M. Commercial activity is prohibited.
4. Exceptions:
a. Municipal repair and maintenance activities for the purpose of maintaining or reinstating village services, including, but not limited to, water, sewer and road repairs and maintenance.
b. Bona fide emergency maintenance and repairs.
c. Hardship relief may be approved by the village board for a designated time period. (Ord. 2015-1092, 10-8-2015)
C. Holidays: No commercial or noncommercial construction and maintenance activities shall be permitted on the following legal holidays: Memorial Day, July 4, Labor Day, Thanksgiving Day, Christmas Day, and New Year's Day.
1. Exceptions:
a. Noncommercial home repair, maintenance and remodeling upon the personal residence of the person or persons engaging in such activities shall also be allowed and permitted from seven o'clock (7:00) A.M. to eight o'clock (8:00) P.M.
b. Municipal repair and maintenance activities for the purpose of maintaining or reinstating village services, including, but not limited to, water, sewer and road repairs and maintenance.
c. Bona fide emergency maintenance and repairs.
d. Hardship relief may be approved by the village board for a designated time period.
D. Place: The restrictions in subsections A, B, and C of this section shall apply only to residential zones and those properties located within one thousand feet (1,000') of any occupied residential unit.
E. Penalties: Any property owner, lessee, or any occupant of any property in the village of South Barrington who allows such noise emanating from construction and maintenance activities on the property owned or occupied by him or her in violation of the provisions of this section shall be fined not less than fifty dollars ($50.00) nor more than seven hundred fifty dollars ($750.00) for each offense; and a separate offense shall be deemed committed on each day during or upon which a violation occurs or continues.
