A. Definition: For the purposes of this section, "approved smoke detector" or "detector" means a smoke detector of the photoelectric type, which complies with all the requirements of the Underwriters Laboratories, Inc., standard UL 217, second edition, October 4, 1978, as revised May 19, 1983.
B. Installation And Maintenance:
1. Every single-family residence, both new and existing, shall have at least one approved smoke detector installed on every story of the dwelling unit, including basements but not including unoccupied attics.
2. Multiple detectors shall be installed as required so that no doorway to a room used for sleeping purposes is more than fifteen feet (15') from the nearest smoke detector.
3. All detectors shall be installed on the ceiling and at least six inches (6") from any wall, or on a wall located between four inches (4") and six inches (6") from the ceiling.
4. It shall be the responsibility of the owner of the property to supply and install all detectors required by this section. The owner shall also be responsible for providing to his tenant (if any) written information regarding detector testing and maintenance. It shall be the responsibility of the tenant (if any) to test and to provide general maintenance for the detectors within the property, and to notify the owner in writing of any deficiencies which the tenant cannot correct.
C. Application Of Provisions: The requirements of this section shall apply to all residential properties as follows:
1. Homes already occupied: The required smoke detectors may be either battery powered or wired into the structure's AC power supply, and need not be interconnected.
2. Homes under construction: Same as above.
3. Permits not yet issued: The required smoke detectors shall be permanently wired into the structure's AC power supply, and if more than one detector is required, the detectors shall be wired so that the actuation of one detector will actuate all detectors. (Ord. 0-88-305, 8-18-1988)
D. Smoke Detectors At Furnace Location: Fire protection at the ceiling level above all gas fired appliances may be fulfilled with either drywall or smoke detectors.
1. Smoke Detectors: A smoke detector shall be installed at the ceiling level of each space or room containing a gas fired appliance (furnace, boiler, hot water heater, etc.) within fifteen feet (15') of each appliance. Each smoke detector shall be connected to the full house one hundred ten (110) volt alarm system.
2. Drywall: Install five-eighths inch (5/8") fire code drywall above all gas fired appliances. Drywall shall extend a distance of four feet (4') beyond the edge of the equipment. All combustible material within this four foot (4') zone shall be covered. All penetrations through this drywall shall be fire stopped. (Ord. 0-93-419, 6-10-1993)
E. Penalty: Wilful failure to install or maintain in operating condition any smoke detector required by this section shall subject the owner to a fine of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each offense, and a separate offense shall be deemed committed on each day during which a violation occurs or continues to exist.
