7-3-1: PERMITS; SCOPE:
   A.   It shall be unlawful to do the following within any village right of way:
      1.   Place or install stones or boulders;
      2.   Construct a masonry, concrete or rigid steel mailbox or delivery marker;
      3.   Construct any masonry, concrete or rigid steel structure or driveway monument;
      4.   Install any rigid roadway markers such as pipes, conduit, stakes, posts, and the like; and
      5.   Construct any walls or landscape features such as islands, berms, retaining walls, and the like.
   B.   It shall be unlawful to do the following within the village right of way without first obtaining a permit:
      1.   Plant any shrubs, bushes or trees,
      2.   Remove any trees in the public right of way,
      3.   Install brick and paver driveways.
   C.   The installation of conventional mailbox supports (wood four inch by four inch (4" x 4") posts) or mailbox supports with materials of a "breakaway" design and the installation of flexible markers seasonally installed during the winter months along the edge of pavement and driveways shall be exempt from the provisions of this chapter.
   D.   It shall be unlawful to plant, place, install or construct anything that obstructs the movement of stormwater through the designed curbs, gutters, culverts and swales
   E.   The village will require compensation for right of way trees extensively damaged and for right of way trees removed without authorization from the building department. The formula developed by the International Society Of Arboriculture will be used as a basis for determining the compensation for damaged trees or unauthorized removal of trees.
   F.   Upon obtaining the required permit to plant or remove a tree in the public right of way, tree removal must be performed by an insured contractor.
   G.   Upon obtaining the required permit to plant or remove a tree in the public right of way, the property owner must notify all utility companies that are a part of the Joint Utility Locating Information For Excavators - JULIE, Inc., of the responsibility of each utility company to locate its utilities. The village will not accept any liability or pay any costs in the event any unknown utilities are uncovered or are damaged by the property owner or contractor.
   H.   The village will not be responsible for any bricks or pavers that are damaged in the public right of way due to road repairs or snowplowing. (Ord. 2013-993, 7-11-2013; amd. Ord. 2016-1144, 11-10-2016; Ord. 2019-1208, 6-13-2019; Ord. 2020-1222, 2-13-2020)
