4-15-1: DUMPSTERS IN RESIDENTIAL ZONING DISTRICTS:
   A.   Dumpster Defined: For purposes of this chapter "dumpster" shall mean any container or receptacle that is one cubic yard or more, designed and used outdoors to hold refuse, garbage, or construction material. This definition is not to include and this chapter does not apply to residential garbage bins utilized for regular residential garbage pick up.
   B.   Permit Required: Dumpsters are temporarily permitted on private property in residential zoning districts provided the property owner first secures a dumpster permit from the village of South Barrington. During a period of active construction or rehabilitation of the subject property, a building permit will be sufficient to authorize the use and location of a dumpster on the property. If not during a period of active construction or rehabilitation, a dumpster permit issued by the village of South Barrington shall be required to authorize the use and location of a dumpster, and in such event, a dumpster permit fee of twenty five dollars ($25.00) shall apply.
   C.   Location Of Dumpsters: Dumpsters may be temporarily located in residential zoning districts provided the dumpster shall be placed within the required zoning setback restrictions, unless the construction dumpster is located on a private driveway, then in such case, the dumpster may be located outside of the front yard setback requirement as long as the dumpster does not obstruct vehicular or pedestrian traffic.
   D.   Duration: Dumpsters may remain located on the property during the period of active construction or rehabilitation provided a building permit has been issued by the village of South Barrington. If not during a period of active construction or rehabilitation, a dumpster may also be temporarily located on the property for a period not to exceed fifteen (15) consecutive days, provided a dumpster permit has been issued by the village of South Barrington.
   E.   Violation; Penalty: Any person violating the provisions of this chapter shall, upon conviction, be fined in an amount not less than twenty five dollars ($25.00), nor more than seven hundred fifty dollars ($750.00) per violation. Each day that a violation continues shall constitute a separate offense. (Ord. 2009-897, 12-10-2009)
