4-2-2: PERMIT REQUIRED:
It shall be unlawful for any person to use any land, premises or property within the Village, or within one mile of the Village limits, for the disposal of any garbage and refuse, or garbage or refuse, without first making application for and securing a permit to do so. The permit shall be granted and issued by the Village Board, and shall be subject to and governed by the following provisions: (Ord. 0-66-77, 6-16-66)
   A.   Application for Permit; Summary of Procedures: The application for a permit to operate a sanitary landfill shall be filed with the Planning Commission/Zoning Board of Appeals and shall contain a description and plat of the land on which the disposal of garbage and refuse, or garbage or refuse, is proposed, a description of the sequence and plan of operation, type and capacity of equipment to be used for operations, plans for fire, nuisance and vermin control, existing and proposed roadways and easements, existing topography and watercourses, together with a diagram and written statement explaining the proposed location and extent of earthwork and fill operations, proposed measures to control storm drainage and estimated daily or weekly volume of garbage and refuse, or garbage or refuse to be placed in the sanitary landfill. When all filling is completed, no site shall be filled in to a height greater than the height of the adjacent terrain.
The application shall also include a statement of the estimated life of the landfill and the intended use of the landfill after its completion.
The application shall be forwarded by the Planning Commission/Zoning Board of Appeals to the Health Officer for study, findings and recommendations; the Health Officer shall return the application to the Planning Commission/Zoning Board of Appeals with his findings and recommendations; the Planning Commission/Zoning Board of Appeals shall forward the application with the findings and recommendations of the Health Officer and Planning Commission/Zoning Board of Appeals to the Village Board.
The Village Board shall not grant a permit for a sanitary landfill operation unless and until a public hearing shall have been held on such application; provided, however, that no permit shall be granted by the Village Board unless the location for which a permit is requested shall be in conformity with State, County and Village ordinances.    B.   Action by Health Officer: The Health Officer shall, on receipt of a sanitary landfill application, determine whether:
      1.   The site is suitable.
      2.   The public health and necessity require the granting of the permit to the applicant.
      3.   The granting of the permit to the applicant is in the best interests of the Village.
      4.   The granting of the permit would not create a hazard to the public health or create a nuisance.
The Health Officer shall also notify the Cook County Health Director, the Illinois State Department of Reclamation, State Geologist and the State Department of Public Health for opinions on potential underground water pollution.
The Health Officer shall make and attach a report of his findings in the above matters to the application and forward it to the Planning Commission/Zoning Board of Appeals.
   C.   Action by Planning Commission/Zoning Board of Appeals: The Planning Commission/Zoning Board of Appeals shall make a study as to the possible effects of the proposed sanitary landfill operation upon the character of the neighborhood, traffic conditions, public utility facilities and operations, streets and other matters pertaining to the general welfare of the Village, and shall advise the Village Board as to whether public convenience and necessity will be served by granting a permit to the applicant.
   D.   Factors to be Considered: In determining whether public necessity and convenience will be served by the granting of a permit to the applicant, both the Health Officer and the Planning Commission/Zoning Board of Appeals shall consider the following matters:
      1.   The number of sanitary landfills necessary for the Village.
      2.   The locations best suited to serve the entire Village and conformity with the provisions contained in this Village Code.
      3.   The length of time that a proposed location can be expected to be used as a sanitary landfill.
      4.   The possible future effects on the area in the vicinity of the proposed sanitary landfill.
   E.   Information to Village Board: After the studies, examinations, findings and reports have been completed by the Health Officer and the Planning Commission/Zoning Board of Appeals, the application shall be forwarded to the Village Board with the reports and recommendations of the Health Officer and the Planning Commission/Zoning Board of Appeals attached.
