A. The Village Corporate Authorities are committed to promoting and protecting the health, safety and welfare of the public and wish to ensure that trick-or-treat visitations at vehicles located in streets or rights-of-way and Tailgating are prohibited due to their inherently dangerous nature.
B. Definitions: As used in this Section, the following terms shall have the following meanings:
TAILGATE: | An event in which an individual hosts or attends a social gathering at a parked vehicle, typically in a parking lot or street for a sports event. The act of attending or hosting such an event is known as "tailgating." |
TRICK-OR-TREAT: | The activity of asking for candy, or treats of the like, during the Halloween season. |
VEHICLE: | A mechanism used for transporting people or goods, such as a car, truck, cart, or any motorized unit of transportation of the like. |
C. Trick-or-Treat from Vehicles Located in Streets and Rights-Of-Way Prohibited: It shall be unlawful for any person to conduct, promote, or take part in trick-or-treat activities when visiting someone's vehicle(s) located in streets or rights-of-way.
D. Tailgating Prohibited: It shall be unlawful for any person to attend or host a tailgate.
E. Penalty: Any violation of this Section upon conviction thereof shall result in a two hundred fifty dollar ($250.00) fine for each offense, and a separate offense shall be deemed committed for each attempt to unlawfully trick-or-treat from a vehicle or engage in Tailgating.
