1129.06 SATELLITE DISH ANTENNA REGULATIONS.
   (a)   Dish-type satellite signal receiving antennas, referred to as “earth-stations” shall mean an antenna of dish shape used for the purpose of receiving airborne signals related to communications from satellite transmissions.
   (b)   No person shall erect or maintain an “earth-station” in excess of three feet in diameter in the Village of South Amherst without first obtaining a building permit from the Zoning Inspector and no construction shall commence before obtaining said permit.
   (c)   The permit fee for erecting an “earth-station” shall be twenty dollars ($20.00).
   (d)   The applicant shall submit along with the building permit application a plot plan of the property, showing the exact location of the proposed “earth-station” and the location of all buildings on the subject property; a complete description of the type of “earth-station” proposed; a set of construction plans, specifications and elevations of the proposed location.
   (e)   A part-owner, occupant, or renter must have written permission from the owner of the property upon which the erection of the “earth-station” is being proposed.
   (f)   No “earth-station” shall be linked to receivers or transmitters which are not located on the same lot or premises as the “earth-station”.
   (g)   The maximum diameter of any “earth-station” shall not exceed twelve feet.
   (h)   The maximum height of an “earth-station” shall not exceed fifteen feet from the natural grade level, unless erected on a structure or pole.
   (i)   No “earth-station” shall be erected on any structure in excess of the height of the residential structure on said lot.
   (j)   No “earth-station” shall be erected in any front yard or within eight feet of any lot line.
   (k)   “Earth-stations” should be painted either gray, white, black, green or earth tones. All surfaces shall be maintained in good condition, free of rust, peeling paint or corrosion.
   (l)   An effort should be made to reasonably conceal the “earth-station” by appropriate evergreen landscaping.
   (m)   An appeal from the decision of the Zoning Inspector may be made to the Board of Zoning Appeals.
   (n)   Whoever violates any of the provisions of this section shall be guilty of a minor misdemeanor.
