§ 117.30  INITIAL APPLICATION AND RENEWAL APPLICATION REQUIREMENTS.
   The gaming permit application must be submitted with the following:
   (A)   Location, by address, of the proposed operation;
   (B)   A site plan including the following details:
      (1)   Overall view of the property;
      (2)   Parking spaces for the location;
      (3)   Floor plan of building;
      (4)   Locations of gaming machines;
      (5)   Windows and doors;
      (6)   Dimensions of building, windows, and doors;
   (C)   The nature of the business (general description) operating the game room;
   (D)   A copy of a certificate of occupancy issued by the Hardin County Emergency Services District #5 for the proposed game room;
   (E)   A certificate of the inventory, along with serial numbers or equivalent identification, of all machines that the permit holder intends to have on site when the gaming site begins its business activities;
   (F)   The non-refundable application or renewal fee as listed in the fee schedule;
   (G)   The occupation tax fee per machine as listed in the fee schedule in section;
   (H)   The regulatory enforcement license fee per machine as listed in the fee schedule;
   (I)   Whether a previous permit of the applicant, or, if applicable, a corporate officer of the applicant, has been revoked within two years of filing of the application;
   (J)   A copy of the certificate of formation if the business is registered with the Secretary of State, or the applicant's DBA, if applicable;
   (K)   In the case of corporate ownership, a copy of the certificate of incorporation;
   (L)   Name, address, telephone number, and driver's license number of the following persons, if applicable:
      (1)   Applicant if a natural person;
      (2)   All persons who own any interest in the amusement redemption machine game room;
      (3)   All corporate officers, if any, of the business;
      (4)   If a partnership, each of the general and limited partners;
      (5)   The property owner; and
      (6)   All operators and employees of the property and/or business.
   (M)   A completed background check and authorization permitting the release of this information to the city for all business owner(s), operator(s), or employee(s) or the proposed game room. In addition, a completed background check and authorization permitting the release of this information to the city is also required for property owners if the property owner owns, operates, or supervises the business operating the amusement redemption machine. The background check will include a Texas and Federal Bureau of Investigation criminal history record information background check. The form authorization permitting release of results of the background checks to the city is available from the city's police department. Upon application or renewal for a license/permit, hiring new operators, or employees of the game room, the applicant is required and shall be financially responsible for obtaining and ensuring that the city has received all background checks as provided and required under this division.
   (N)   A sworn statement that:
      (1)   All the facts contained in the application are true and correct;
      (2)   The location and operation of the amusement redemption machine game room will not violate any applicable deed restrictions; and
      (3)   The amusement redemption machine game room will be operated in accordance with all laws and city ordinances, including V.T.C.A., Penal Code Ch. 47.
   (O)   Name, address, and telephone number of an emergency contact person who can be reached  after hours.
   (P)   Any false statement made by an applicant on the application shall subject the permit to immediate suspension pending revocation and the applicant may be prosecuted as a violation of V.T.C.A., Penal Code § 37.10, (tampering with governmental records), a third degree felony.
