This section does not apply to any person who commits any act described in this section pursuant to the direction or prescription of a licensed physician or dentist licensed by the State of Texas to direct or prescribe such act. This section likewise does not apply to the inhalation of anesthesia for a medical or dental purpose. Each continuing day's violation under this section shall constitute a separate offense. The penal provisions imposed under this section shall not preclude the city from filing suit to enjoin the violation. The city retains all legal rights and remedies available to it pursuant to local, state and federal law.
