§ 152.24  MOBILE HOME PARK STANDARDS OR MANUFACTURED HOME PARK STANDARDS.
   Any mobile home park constructed after adoption of this subchapter, and any extension and/or addition to an existing mobile home park or manufactured home park in the city shall be done in compliance with the following site requirements.
   (A)   Density and site requirements.
      (1)   Density. A mobile home park shall have no more than six spaces per acre. The areas of separate uses and structure not dedicated exclusively to the operation of the park, but contained within the park boundaries shall be subtracted from the total area for density calculation and meet the requirement hereof.
      (2)   Basic mobile home minimum site requirement.
         (a)   Height regulations.
            1.   The height limit for any structure intended for occupancy in the mobile home park shall be 35 feet.
            2.   The average height of the mobile home frame above ground elevation, measured at 90 degrees to the frame, shall not exceed four feet from the top of the pad.
         (b)   Spacing regulation. Mobile homes or manufactured homes shall be located no closer than 16 feet from either exterior side wall to the closest exterior side wall of the nearest mobile home and 20 feet from the front or rear exterior wall of a mobile home to the closest wall of the adjacent mobile home.
         (c)   Drainage. The ground surface in all parts of a park shall drain surface water in a safe, efficient manner.
         (d)   Design and location of storage facilities. Storage facilities with a minimum measurement of 48 square feet per mobile home space, shall be provided on the space. Storage facilities shall be faced with a durable, fire resistant material. Storage outside the perimeter walls of the mobile home shall be permitted only if in the facilities. No storage shall be permitted under a mobile home or manufactured home.
         (e)   Tie downs. Tie downs on all mobile homes or manufactured homes shall comply with the tie downs standards of the Standard Building Code, Appendix H, and its future updates.
         (f)   Skirting required. All mobile homes or manufactured homes shall be skirted with vinyl, masonry, wood or metal material. Vinyl or metal siding skirting shall be attached securely to the mobile home and properly anchored to the ground. Wood or metal materials shall have a stained or painted finish.
      (3)   Access, traffic circulation, parking.
         (a)   Internal streets shall be privately owned, built and maintained. Street shall be designed for safe and convenient access to all spaces and facilities for common use of park residents.
         (b)   All internal streets shall be constructed to specification set by the City Council and shall be maintained by the owner. The streets shall be constructed with a smooth, hard and dense surface, which shall be durable and well drained under normal use and weather conditions.
      (4)   Internal street dimensions; parking.
         (a)   Internal streets shall be minimum width of 22 feet if off-street parking is provided at the rate of two parking places per mobile home space.
         (b)   Parking spaces shall be constructed of shell, concrete asphalt or rock and sand prepared.
         (c)   Internal streets shall permit unobstructed access to within 100 feet of any portion of each mobile home or manufactured home.
      (5)   Names and numbers. Within each mobile home park or manufactured home park, streets shall be named, and mobile homes or manufactured homes numbered. Park signs and numbers shall be of standard size and placement to facilitate location by emergency vehicles. Interior street shall intersect adjoining public streets at approximately 90 degrees and at locations which will eliminate or reduce interference with traffic on public streets.
   (C)   Street lighting. Street lighting within the mobile home park or manufactured home park shall be provided by one lamp of at least 75 watts (mercury vapor) or 100 watts (high pressure sodium) per one-half acre of mobile home park or manufactured home park area.
   (D)   Dependent mobile home. No dependant mobile home shall be allowed in a mobile home park or manufactured home park within the city limits unless separate shower and toilet facilities for men and women are available and are within 200 feet of any dependant mobile home.
   (E)   Fire safety standards.
      (1)   The storage, handling and use of liquefied petroleum gases and flammable liquids shall be done in compliance with applicable city ordinance and state statutes.
      (2)   Access to mobile home or manufactured home for firefighting approaches to all mobile homes or manufactured homes shall be kept clear for emergency vehicles.
      (3)   The mobile home park or manufactured home park owner or agent shall provide an adequate system of collection and safe disposal of rubbish.
   (F)   Water supply.
      (1)   All approved water supply for domestic use and fire protection purposes shall be supplied to meet the requirement of the mobile home park or manufactured home park.
      (2)   All plumbing shall be in accordance with applicable ordinances of the city.
   (G)   Sewage disposal. From and after the effective date of this subchapter, the following shall apply:
      (1)   Waste from all toilets, lavatories, sinks and showers in mobile home parks shall be discharged into a public sewer or private system approved by the City Council.
      (2)   All plumbing shall comply with applicable Plumbing Codes.
      (3)   Each mobile home or manufactured home stand shall have a sewer riser pipe of at least four inches, which shall be, capped when not in use.
   (H)   Electrical and telephone distribution system. From and after the effective date of this subchapter, the electrical distribution system shall comply with applicable electrical codes and other applicable laws of the state.
   (I)   Bathroom, laundry. All rooms containing bathroom or laundry facilities shall have fire-resistant walls extending to the ceiling between male and female sanitary facilities. Walls and partitions around showers, tubs, lavatories and other plumbing fixtures shall be constructed of dense, non-absorbent, waterproof materials or covered with moisture resistant materials.
   (J)   Refuse and garbage. Solid waste shall be stored in fly proof, waterproof containers, which shall be emptied regularly and maintained in a usable, sanitary condition and the collection and disposal of said refuse and garbage shall be so conducted as to create no health hazard.
   (K)   Insect and rodent control and sanitation. Grounds, buildings and structure shall be maintained in a sanitary, pest free condition.
   (L)   Registry.
      (1)   It shall be the duty of the owner to keep a register of park occupancy, which shall contain the following information:
         (a)   Name and address of owner and occupant;
         (b)   The make, model, serial number, year and dimensions of all mobile homes;
         (c)   The date of arrival and departure of each mobile home; and
         (d)   The space number occupied by each mobile home.
      (2)   The park operator shall submit the park register to the City Council January 1 each year and shall make the register available to any authorized city official upon reasonable request. Upon gaining knowledge of a departure of any mobile home, the park operator shall notify the County Tax Collector. Failure to do so shall place the operator in violation of this subchapter.
   (M)   Requirements to be met. It shall be the responsibility of the owner to ensure that all requirements of this subchapter are met and maintained. Any mobile home park that is found to be in violation of any provision of this subchapter shall be notified in writing by the City Council in accordance with § 152.23.
   (N)   Non-conforming mobile home parks.
      (1)   Any mobile home park or manufactured home park in use and/or existence on the effective date of this subchapter, and not complying with all applicable provisions of this subchapter shall be considered a non-conforming mobile home park or manufactured home park. The non-conforming mobile home parks or manufactured home park shall be required to submit a site plan in accordance herewith showing the development and layout of the park as existing on the adoption date of this subchapter and shall be submitted within six months of that adoption date, applying to the four existing mobile home parks within the city.
      (2)   Any land area added to, or mobile home spaces developed within a non-conforming mobile home park shall conform to all requirements of this subchapter.
      (3)   Notwithstanding the preceding provisions of this subchapter, all non-conforming mobile home parks shall comply with the terms hereof within six years of the effective date of this subchapter.
   (O)   Miscellaneous requirements.
      (1)   Responsibilities of the park owner.
         (a)   All responsibilities set out elsewhere in this subchapter shall apply.
         (b)   The owner or agent shall operate the park in compliance with this and other applicable ordinances and shall provide adequate supervision to maintain the park and all facilities in good repair, and in clean and sanitary condition.
         (c)   The owner or agent shall notify park occupants of all applicable provisions of this subchapter and inform them of their duties and responsibilities under this subchapter.
      (2)   Responsibilities of park occupants.
         (a)   All responsibilities of occupants set out elsewhere in this subchapter shall apply.
         (b)   The park occupant shall comply with all requirements of this subchapter.
         (c)   The park occupant shall be responsible for proper placement of his or her mobile home or manufactured home in its mobile home or manufactured home stand placement of his or her mobile home or manufactured home in its stand and proper installation of all utility connections in accordance with the instructions of the park management.
         (d)   The use of space immediately beneath a mobile home or manufactured home for storage shall not be permitted.
