§ 111.09  RULES AND REGULATIONS GENERALLY.
   (A)   Each company will conform to the following laws, rules, regulations and ethical procedures.
      (1)   Wrecker operators are required to remove debris from the roadway as specified by Tex. Occup. Code Ch. 2308.
      (2)   Wrecker companies are required to follow “storage fee/charges” or, as outlined herein, vehicle storage facilities in the motor carrier rules and regulations.
      (3)   Wrecker companies are required to follow “facility requirements”, as outlined herein, vehicle storage in the motor carrier rules an regulations.
      (4)   Liability insurance requirement shall be complied with by all participating non-consent system wrecker companies, and only those vehicles covered by proof of financial responsibility shall be utilized.
      (5)   Solicitation will not be allowed by wrecker operators or owners/operator of vehicles in the following situation at the scene of a traffic collision:
         (a)   When owner/operator is injured;
         (b)   Upon arrival of an officer, or when otherwise directed by any other police officer who may be on the scene first; and/or
         (c)   No police officer investigating or present at the scene of any wrecker, accident or collision on a public street shall, directly or indirectly, either by word, gesture, sign or otherwise, recommend to any person the name of any particular person engaged in the wrecker services of repair business; nor shall any police officer influence or attempt to influence, in any manner, the decision of any person in choosing or selecting a wrecker or repair service.
   (B)   No person may officially act on his or her company’s behalf at an incident/accident scene, unless he or she has an available wrecker already on the scene.
   (C)   Wrecker must operate in conformity with all state laws.
   (D)   Normally, wrecker’s vehicles in violation will not be allowed to pick up.
      (1)   Minor violations, when first detected, will not preclude a wrecker operator from picking up.
      (2)   Minor violations which have been brought to the attention of the owner/operator and the owner/operator has not complied with a reasonable amount of time the wrecker will not be allowed to pick up.
      (3)   Wreckers violating moving traffic laws en route to a scene will not be allowed to pick up.
   (E)   Wreckers designated to pick up a vehicle will be responsible to secure any additional assistance to remove vehicle safely from the scene.
