§ 70.20  HANDICAPPED PARKING.
   (A)   No parking places.
      (1)   At any time, it shall be unlawful to permit any vehicle to stand in any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device, unless otherwise authorized as herein provided:
         (a)   At any place where official signs prohibit parking; and
         (b)   Specifically designated parking spaces for mobility handicapped persons for every space marked distinctly “handicapped parking”.
      (2)   It shall be unlawful for any person without a mobility handicap or not using a wheelchair to park in any space reserved for the handicapped persons; provided, however, that, a driver of a vehicle used in transporting the handicapped persons may park in the spaces.
   (B)   Signs posted. The Chief of Police, City Manager or any other person authorized by the Mayor and City Council shall cause signs to be posted in all areas where parking is limited or prohibited, indicating the limitations or prohibitions.
   (C)   Parking prohibited in spaces designated for disabled persons.
      (1)   It is unlawful for any person to park or leave standing any vehicle in a stall or space designed for physically handicapped persons, if, immediately adjacent to and visible from the stall or space, there is posted a sign known as the international wheelchair symbol consisting of a profile view of a stylized wheelchair with occupant in white on a blue background, unless the driver of the car is disabled.
      (2)   As used in this section, DISABLED means either having a physical condition requiring either the use of a wheelchair, artificial limb, crutch, cane or walker, and having a physical disease making it difficult to walk more than 25 feet without shortness of breath or danger of impairment of health. A certificate by a person licensed to practice the healing arts in the state shall be acceptable by the city as evidence under this section.
      (3)   The provision of this division (C) shall apply to all street and off-street parking facilities owned or operated by the city or by any privately owned or operated parking lot.
   (D)   Effective date. This section shall be effective from and after its passage and publication of the caption of the ordinance codified herein.
