§ 54.21  AUTHORITY TO DISCONNECT SERVICE.
   (A)   The city may terminate water and wastewater disposal service and disconnect a user from the system when:
      (1)   Acids or chemicals which may damage the sewer lines or treatment process are released to the sewer potentially causing accelerated deterioration of these structures or interfering with the proper conveyance and treatment of wastewater;
      (2)   A governmental agency informs the city that the effluent from the wastewater treatment plant is no longer of a quality permitted for discharge to a watercourse, and it is found that the user is delivering wastewater to the city’s system that cannot be sufficiently treated or requires treatment that is not provided by the city as normal domestic treatment; or
      (3)   The user:
         (a)   Discharges wastewater at an uncontrolled, variable rate in sufficient quantity to cause an imbalance in the wastewater treatment system;
         (b)   Fails to pay monthly bills for water and sanitary sewer services when due;
         (c)   Repeats a discharge of prohibited wastes to public sewers in violation of §§ 54.02 through 54.10; and
         (d)   Fails to properly maintain private facilities such that sewer and/or wastewater accumulates, discharges or flows onto public or private land or the user fails to connect to the city sewer system where that service has been provided and made available.
   (B)   If service is discontinued pursuant to divisions (A)(2) or (A)(3) above, the city shall:
      (1)   Supply the user with the governmental agency’s report and provide the customer with all pertinent information;
      (2)   Serve the user with a written notice of the violation describing the nature of the violation and prescribing a reasonable time limit for its correction;
      (3)   If appropriate, require the user to report the cause of the violation and to submit a schedule for its correction;
      (4)   Disconnect the user if the violation remains uncorrected after the end of the specified time limit; and
      (5)   Continue disconnection until such time as the user:
         (a)   Provides pretreatment/additional pretreatment or other facilities designed to remove the objectionable characteristics from his or her wastes; and
         (b)   Pays all outstanding charges for city services (including late payment penalties, any lawfully assessed fines or damages, and all disconnection and reconnection charges).
