Council, pursuant to Civil Service Commission Rule 4(h), hereby declares its intent that the position of the Assistant Chief in the Police Department shall be an exempt, non-civil service classified position. The Mayor, pursuant to Article V, § 5(b), of the City Charter, shall appoint the Assistant Chief upon the recommendation of the Police Chief. The Assistant Chief may be terminated for just cause by the Mayor pursuant to Article V, § 5(b), of the City Charter with recommendation for termination by the Police Chief. The Assistant Chief may also be transferred or reduced by the Mayor with recommendation for such transfer or reduction by the Police Chief. If the Assistant Chief was appointed to the position from the classified civil service status in the Police Department, the Assistant Chief shall revert to the classified civil service status held by him or her at the time of his or her appointment if he or she is transferred or reduced.
