§ 634.05 LOUDSPEAKERS; AMPLIFIERS.
   (a)   No person shall use any radio receiving set, musical instrument, phonograph, loudspeaker, sound amplifier or other machine or device for the producing or reproducing of sound which is cast upon the public streets for the purpose of commercial advertising or attracting the attention of the public.

   (b)   Whoever violates this section is guilty of a misdemeanor of the third degree.

§ 634.06 EXHAUSTS.
   (a)   No person shall discharge into the open air the exhaust of any steam engine, stationary internal combustion engine, motor boat or motor vehicle except through a muffler or other device which will effectively prevent loud or explosive noises therefrom.

   (b)   Whoever violates this section is guilty of a misdemeanor of the third degree and shall be subject to the penalty provided in § 698.02.

§ 634.07 BUILDING OR PROPERTY USE RESTRICTIONS.
   (a)   No person owning or in possession or control of any building or premises shall use the same, permit the use of the same or rent the same to be used for any business, employment or residential use, or for any purpose of pleasure or recreation, if such use shall, by its boisterous nature, substantially raise the ambient noise level of the neighborhood in which such building or premises is situated, or would be dangerous or detrimental to health.
   (b)   Whoever violates this section is guilty of a misdemeanor of the third degree.

§ 634.08 RESTRICTED USE OF POWER EQUIPMENT, TOOLS AND MACHINERY IN NON-RESIDENTIALLY ZONED AREAS AND IN COMMERCIAL CONSTRUCTION PROJECTS WITHIN RESIDENTIALLY ZONED AREAS.
   (a)   No person shall operate power equipment, construction tools, machinery and/or perform any construction related activity on any non-residentially zoned property, or as part of any commercial construction project in any residential zoned area, between the hours of 7:00 p.m. and 7:00 a.m., or at any time on Sundays, except for emergency situations or by approval of the City Safety Director with the specific authorization of Council.
      Power equipment, construction tools, and machinery that are subject to this section shall include tractors, dozers, rotary drills, augers, loaders, earth movers, power shovels, back hoes, cranes, derricks, paving machines, dump trucks, mixers, ditchers, trenchers, compactors, scrapers, jack hammers, pavement breakers, compressors, hammers, axes, mauls, pneumatic powered equipment, pile drivers, chain saws, log splitters, log chippers, powered hand tools, lawn tractors and mowers, leaf blowers, trimmers and/or any other equipment, tool or machinery that is substantially similar to the foregoing.
      This section shall not apply to the use of snow blowers, snow plowing, or the use of any other tool or equipment used in the mitigating of an immediate health, safety, welfare related emergency, as determined by the City of Solon Police Department.
   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree.

§ 634.09 MOTOR VEHICLE LIMITS.
   (a)   No person shall operate any motor of a motor vehicle of a weight in excess of four tons (8,000 pounds) for a consecutive period longer than two minutes which operation shall raise the noise level above the ambient noise level of the neighborhood by more than six decibels, between the hours of 9:30 p.m. and 7:00 a.m. of the following day or on Sundays or holidays. This section shall not apply to buses operated for the transportation of passengers while standing in established bus turnarounds, bus terminals, bus parking lots and bus storage yards.
   (b)   Whoever violates this section is guilty of a misdemeanor of the third degree.
