(a) Concrete sidewalks shall be constructed in connection with street improvements in a subdivision unless specifically waived by the Planning Commission upon a showing by the developer that, because of unique conditions in the subdivision, the elimination of sidewalks will not adversely affect the health, safety and welfare of the present and future residents of the subdivision and citizens of the city. Additionally, temporary sidewalks of asphalt or macadam material may be installed in special circumstances under such reasonable rules and regulations as are necessary in the circumstances when approved by the City Engineer and the Planning Commission.
(b) In subdivisions in the process of development, any required concrete sidewalks shall be completely installed on the side of any street for its entire length when residences have been built and occupied on 60% or more of the lots on such side of the street, notwithstanding the filing of an improvement bond provided for in § 1242.02(f).
