For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter and the regulations arising from this chapter are defined as follows:
ALUMINUM. Aluminum cans, aluminum foil and aluminum containers or trays used in packaging, preparation or cooking of food.
AUTHORIZED LITTER RECEPTACLES. Receptacles for the use of the general public placed outdoors by the city or by private persons on either public or private property. The receptacles shall be designed so as to prevent the escape of litter onto any public or private property.
AUTHORIZED RECYCLING RECEPTACLE. A recycling receptacle provided by the city or paper leaf bag used to contain yard waste.
AUTHORIZED AND APPROVED REFUSE RECEPTACLES. Authorized recycling receptacles and authorized rubbish receptacles.
AUTHORIZED AND APPROVED RUBBISH RECEPTACLES. Up to a 95- or 65-gallon rubbish receptacle provided by the city that contain rubbish generated by owners or occupants for collection pursuant to this chapter. Residents may, at their option and according to their need, obtain a maximum of one second container from the city at a cost of $70.
BRUSH WASTE. Tree limbs resulting from tree trimming, woody vines, branches and twigs longer than two feet in length and one-half inch in diameter.
CONSTRUCTION DEBRIS. Concrete, asphalt, framing lumber, gypsum wallboard, rubble, roofing materials, plumbing fixtures, windows, insulation, garage doors, railroad ties (weathered), bricks, blocks and siding.
CORRUGATED CARDBOARD. Paper in which a portion has been made to have a wavy surface (alternating ridges and grooves) and is placed between two flat surfaces for the sake of strength, and which is commonly used to form cartons.
GLASS CONTAINERS. Bottles and jars of any color, made of silica, sand, soda ash, and limestone, being transparent or translucent, and used for packaging or bottling various materials. This does not include plastics or glass products such as window glass, blue glass, flat glass, mirrors, plate glass, light bulbs, dishes or ceramics.
HOUSEHOLD RECYCLING RECEPTACLES. A container authorized and approved by the city, used to store recyclables before they are collected in the curbside recycling program.
LEAVES. Deciduous and coniferous seasonal deposition from trees.
LITTER. All refuse, and includes any other waste material which, if thrown or deposited as prohibited in this chapter, tends to create a danger or nuisance to public health, safety or welfare.
MAGAZINES. Publications printed on glossy, clay-coated paper.
NEWSPAPER. Newsprint-grade paper, the common, inexpensive machine-finished paper made chiefly from wood pulp, which is printed and distributed, and not include newspaper soiled by food, paint, petroleum products, oil or oil solvents, or other solid wastes that are not recyclable.
OCCUPANT. Any person living, sleeping or cooking in, or conducting any commercial or nonprofit activity, or having actual possession of any building or part thereof.
OWNER. Any person or entity which alone or jointly or severally with others:
(1) Shall have legal or equitable title to any private property with or without accompanying actual possession thereof; or
(2) Shall have charge, care or control of any private property as owner or agent or as executor, administrator, trustee or guardian of the estate of the owner or any other person in a representative capacity.
PAPER LEAF BAG. A sanitary kraft paper sack or equal of 30-gallon capacity, two-ply 50-pound wet strength with decomposing glue and reinforced self-supporting square bottom closure.
RECYCLABLE MATERIALS. Any type of refuse designated by the Service Department through rules and regulations issued under this chapter to be separated for recycling or composting.
RECYCLABLE PLASTIC. Clear and colored plastic bottles and jugs marked #1-#7 with the exception of styrofoam and plastic film or bags.
REFUSE. All solid waste generated by occupiers of land and designated for handling, collection and disposal pursuant to this chapter excluding construction demolition debris.
REASONABLE ACCUMULATION. The normal accumulation of refuse on a weekly basis from a residential dwelling.
RUBBISH. All refuse excluding recyclable materials.
SECONDARY RECYCLABLES. Computers, printers, small appliances, batteries, propane cylinders, light metals, household hazardous waste items such as, paints, stains, pool chemicals, fertilizers, oil, anti-freeze and used fire extinguishers.
TREE LAWN. The portion of the street right-of-way between the traveled and/or paved portion of the roadway to the nearest line of any existing sidewalk or to the street right-of-way boundary.
WHITE GOODS. Major kitchen and laundry application including, but not limited to, stoves, washers, refrigerators and dryers. Nothing in this definition shall waive compliance with the rules and regulations for the generation, transportation, storage and disposal of hazardous waste.
YARD WASTE. Grass clippings, weeds, hedge clippings, garden waste, and twigs and brush not longer than two feet in length and one-half inch in diameter.
