§ 868.01 PERMIT REQUIRED; APPLICATION; BOND.
   (a)   Any person desiring to remove topsoil, loam, sand, gravel or other substances from land located in any area within the city, shall file with the City Engineer a written application for permission to carry on such operations. Such application shall contain the following information:
      (1)   The name and address of the applicant;
      (2)   A description of the land on which such operations are to take place; and
      (3)   The method of removal to be employed, the time within which such work is to be commenced and completed, the depth to which such removal is to take place, the type of reseeding or replanting proposed and the proposed ultimate use of the land.
   (b)   Such application shall also contain a statement that the applicant will furnish a performance bond in the sum of $5,000 per acre or fraction thereof in the event that the permit is granted.
   (c)   Such application shall be forwarded to the Board of Zoning Appeals by the City Engineer, together with his or her report and recommendation thereon.
