§ 115.05 INSURANCE.
   (A)   (1)   No person shall drill or be issued a permit to drill an oil or gas well within the village unless he or she shall procure and keep in force comprehensive commercial general liability insurance including premises-operations; contractual liability; product liability and completed operation; broad form property damage; and professional liability coverage with limits of $1,000,000 or greater.
      (2)   The insurance in division (A)(1) above shall be primary insurance as respects to village, its elected officials, employees and volunteers and any insurance maintained by the village, its elected officials, employees or volunteers shall be excess to the vendor/contractor’s insurance and shall not contribute to it.
   (B)   (1)   Any person who shall operate a producing well shall, prior to the commencement of the operation, or any person operating a producing well at the time this section becomes effective shall, within 15 days after the effective date hereof, procure and keep in force for the full life of the well, comprehensive commercial general liability insurance including premises-operations; contractual liability; product liability and completed operation; and broad form property damage with limits of $1,000,000 or greater.
      (2)   The insurance in division (B)(1) above shall be primary insurance as respects to the village, its elected officials, employees and volunteers and any insurance maintained by the village, its elected officials, employees or volunteers shall be excess to the vendor/contractor’s insurance and shall not contribute to it.
   (C)   The operator shall forthwith file with the Mayor a certificate of insurance executed by a duly authorized agent of the insurer stating the coverage, limits, the effective dates and expiration dates of the policy of insurance. The persons operating a well shall hereafter keep on file with the Mayor like certificates showing renewals or continuance in force of the required policies of insurance at all times during the operation of the well.
