§ 90.26 FARM ANIMALS PROHIBITED.
   (A)   Except as permitted herein, no person or entity shall keep or harbor any cows, horses, sheep, swine, goats, bison, deer, llamas or other livestock, or poultry or fowl within the corporate limits of the village.
   (B)   Whoever violates this section is guilty of a minor misdemeanor on a first offense and a fourth degree misdemeanor for each subsequent offense. In the event that the animal creates a risk of or cause physical harm to persons or property, the person shall be guilty of a fourth degree misdemeanor on a first and any subsequent offense. Each day during which such violation continues shall constitute a separate offense.
   (C)   This section shall not apply to a person or entity that owns and has dedicated for the keeping or harboring of any animal described in division (A) above, a total of ten or more contiguous acres.
   (D)   Grandfathered animals. This section shall not apply to any cows, horses, sheep, swine, goats or other livestock, poultry, or fowl who are harbored or kept within the corporate limits of the village upon the effective date of this section ("grandfathered animals") for their natural lives so long as the owner of said animal(s) shall register the type, number, and other identifying information as may be required by the village of said animals existing at the effective date of this section within the village. The owner may not replace deceased or transferred grandfathered animals with replacement or other animal.
   (E)   Rabbits, poultry or fowl. This section shall not apply to:
      (1)   This section shall not apply to small farm animals that are kept within the village limits. For purposes of this section SMALL FARM ANIMALS shall be defined and limited to rabbits, poultry, or fowl. The total number of any small farm animals that are exempt under this section shall be limited to five or fewer per household, subject to the following conditions and restrictions:
         (a)   The harboring of said small farm animals shall not create a nuisance.
         (b)   There is no on-premises sale, no mechanical equipment is used except that of a type that is similar in character to that normally used for purely domestic or household animal purposes, and provided that no display will indicate from the exterior of the building or land that it is being utilized in part for any purpose other than residential purposes. The animals must be contained within the existing structures contained within the lot and may not be free-range.
         (c)   All noise, waste and smell must be abated.
      (2)   Maintenance. Owner shall ensure that any feed or bedding for any small farm animal permitted under this section shall be stored in rodent-proof containers or housing. All animal waste shall be removed from the property and shall not be accumulated on property within the village. Animals shall be penned or caged or otherwise retained in appropriate facilities at all times.
