§ 38.06 POLICE PROTECTION FOR NONRESIDENT SERVICE.
   (A)   Within Wayne County. The Chief of Police, the Police Sergeant or the on duty officer in charge, regardless of rank, may authorize mutual aid to the Wayne County Sheriff's Office, the Ohio State Highway Patrol, or to any municipal or village law enforcement agency, upon request of the head of the requesting agency or the officer in charge of that agency. Any aid sent in the form of officers or equipment must not substantially detract from reasonable minimums necessary to provide police protection for the Village of Smithville.
   (B)   Outside Wayne County. Mutual aid requests originating from outside Wayne County require approval from the Chief of Police or, in the Chief's absence, approval from the Police Sergeant.
   (C)   Law enforcement activity. Regardless of location, mutual aid will be sent only for law enforcement related activity. Mutual aid will not be approved for labor-related problems, civil unrest or any non-violent civil situation. The officer in charge approving mutual aid must cause notification of the Chief of Police or Police Sergeant when aid in sent and must submit a written report of officers and equipment sent, time involved and the actions taken prior to the officer's relief from duty.
   (D)   Liability. Officers responding to requests for mutual aid are reminded that liability for their actions and care of equipment does not transfer to the requesting agency, but rests with the Village of Smithville and the individual officer.
