For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALLEY. A public right-of-way which affords a secondary means of access to abutting property.
BLOCK. An area of land within a subdivision that is entirely bounded by streets, or by streets and the exterior boundary or boundaries of the subdivision, or a combination of the above with a river or lake.
BOULEVARD. The portion of the street right-of-way between the curb line and the property line.
CITY. The City of Slayton.
CITY COUNCIL. The governing body of the City of Slayton.
DESIGN STANDARDS. The specifications to land owners or subdividers for the preparation of plats, both preliminary and final, indicating among other things, the optimum, minimum or maximum dimensions of the items as rights-of-way, blocks, easements and lots.
EASEMENT. A grant by a property owner for the use of a strip of land for the purpose of constructing and maintaining drives and utilities including, but not limited to, sanitary sewers, water mains, electric lines, telephone lines, storm sewer or storm drainage ways, gas lines and communication lines.
FINAL PLAT. A drawing or map of a subdivision, meeting all of the requirements of the city and in the form as required by Murray County for the purpose of recording.
LAND USE PLAN. The document containing maps, texts and policy statements that addresses the long range development of the City of Slayton.
LOT. A portion of a subdivision or other parcel of land intended for development or for transfer of ownership.
OUTLOT. A lot remnant or parcel of land left over after platting, which is intended as open space or other use, for which no development is intended.
OWNER. Includes the plural as well as the singular, and where appropriate includes a natural person, partnership, firm association, public or quasi-public corporation, private corporation, or a combination of them.
PARKS and PLAYGROUNDS. Are public lands and open spaces in the City of Slayton dedicated or reserved for recreation purposes.
PEDESTRIAN WAY. A public right-of-way or private easement across a block to provide access for pedestrians and which may be used for the installation of utilities.
PERCENTAGE OF GRADE. On street center line, the distance vertically (up or down) from the horizontal in feet and tenths of a foot for each 100 feet of horizontal distance.
PLANNING COMMISSION. The Planning Commission of the City of Slayton.
PRELIMINARY PLAT. A tentative drawing or map of a proposed subdivision meeting requirements herein enumerated.
PROTECTIVE COVENANTS. Contracts entered into between private parties and constitute a restriction of the use of all private property within a subdivision generally intended for the benefit of the property owners and for providing mutual protection against undesirable aspects of development which would tend to impair stability of values.
SETBACK LINE. A line within a lot designated on the preliminary plat between which, and the adjacent street, the erection of an enclosed structure, or portion thereof is prohibited.
STREET. A public right-of-way affording primary access by pedestrians and vehicles to abutting properties, whether designated as a street, highway, thoroughfare, parkway, road, avenue or boulevard.
STREET, MINOR (LOCAL) STREET. Those which are used primarily for access to abutting properties.
STREET, MARGINAL ACCESS (SERVICE ROAD) STREET. Minor streets which are parallel and adjacent to thoroughfares and highways; and which provide access to abutting properties and protection from through traffic.
STREET, CUL-DE-SAC. A minor street with only 1 outlet and having an appropriate terminal for the safe and convenient reversal of traffic movement.
STREET WIDTH. The shortest distance between lot lines delineating the street right-of-way.
STREETS, ARTERIAL. Those highways or major roads used for high volumes of traffic, and serving as the major links between the major sub-areas of the region or community.
STREETS, COLLECTOR STREET. Those that carry traffic from minor streets to the major system of arterials, including the principal entrance streets of residential districts.
SUBDIVIDER. Any individual, firm, association, syndicate, copartnership, corporation, trust or other legal entity having sufficient proprietary interest in the land sought to be subdivided to commence and maintain proceedings to subdivide the same under this chapter.
SUBDIVISION. A described tract of land which is to be or has been divided into 2 or more lots or parcels, the purpose of transfer of ownership or building development, or, if a new street is involved, any division of a parcel of land. The term includes resubdivision and, where it is appropriate to the context, relates either to the process of subdividing or to the land subdivided.
