§ 110.49   COMPLIANCE CHECKS.
   (A)   The license holder will be subject to compliance checks. At least 2 times every year law enforcement personnel or persons designated by law enforcement shall conduct random, unannounced inspections of licensees to test compliance with age-of-sale laws.
   (B)   These inspections shall include, but not be limited to, surveillance including minors under the age of 18 who attempt to purchase tobacco products.
   (C)   A finding of noncompliance during a like unannounced inspection shall constitute a violation of this section. Additional compliance checks during the license year shall be required following a violation by any licensed retail tobacco outlet.
