§ 110.46   RESTRICTIONS.
   The following restrictions shall apply to each licensee, and the premises licensed hereunder.
   (A)   Age limit. No person or licensee shall sell or give away any tobacco, tobacco paper or tobacco wrapper to any person below the age of 18 years.
   (B)   Specific location for sales. No license shall be issued to any applicant for the sale of cigarettes or cigarette wrappers at any place other than at the applicant’s established place of business.
   (C)   Permanent location.
      (1)   One license per business.
      (2)   No license shall be issued for the sale of cigarettes or cigarette wrappers at any moveable place of business and no license shall be issued for the sale of tobacco at more than 1 place of business.
   (D)   Self-help prohibited.
      (1)   All sales of tobacco related products must be made in a manner that requires the purchaser to specifically ask a clerk for the tobacco-related product in compliance with division (G) below.
      (2)   All other sales of tobacco related products, including self-service merchandising vending machines and other mechanical devices, are unlawful.
   (E)   Use of vending machine illegal. No person shall install, set up or keep any vending machine or other mechanical device for the sale of tobacco related products with the intent to sell the items by that method.
   (F)   Customers to provide proof of age. Every person selling any tobacco related products to any person who appears to be under the legal age must require proof of age by 1 of the following:
      (1)   A valid driver’s license or identification card issued by Minnesota, another state or a province of Canada and including the photograph and date of birth of the licensed person;
      (2)   A valid military identification card issued by the United States Department of Defense; or
      (3)   In the case of a foreign national, from a nation other than Canada, a valid passport.
   (G)   Compliance date for self-help products. All self-service tobacco products shall be located behind a service counter or locked doors by July 1, 1999, provided that for cartons of tobacco products, all self-service shall be so located by October 1, 1999.
