(A) General requirement.
(1) No person, except a wholesaler or manufacturer to the extent authorized under state license, shall directly or indirectly deal in, sell or keep for sale in the city any intoxicating liquor without a license to do so as provided in this chapter.
(2) Intoxicating liquor licenses shall be of 5 kinds:
(a) On-sale;
(b) Off-sale;
(c) On-sale wine;
(d) Special club; and
(e) Sunday on-sale licenses.
(B) On-sale licenses. On-sale licenses shall be issued only to hotels, clubs, restaurants and exclusive liquor stores and shall permit on-sale of liquor only.
(C) Off-sale licenses.
(1) Off-sale licenses shall be issued only to exclusive liquor stores and shall permit off-sale of liquor only. No off-sale license approved by the City Council will become effective until it has also been approved by the Commissioner of Public Safety.
(2) Applicants for off-sale licenses shall be required to have a separate area for the display and sale of liquor which is not directly accessible to an on-sale facility. Holders of off-sale licenses shall be required to comply with all applicable state laws and regulations.
(D) On-sale wine licenses.
(1) On-sale wine licenses shall be issued only to restaurants meeting the qualifications of M.S.A. § 340A.404, Subd. 5 (as amended from time to time), and shall permit only the sale of wine not exceeding 14% alcohol by volume, for consumption on the licensed premises only, in conjunction with the sale of food.
(2) The licenses, when issued under this division, shall not count against the maximum number of on-sale licenses to be issued by the city. No on-sale wine license approved by the City Council shall become effective until it also has been approved by the Commissioner of Public Safety.
(E) Special club licenses.
(1) Special club licenses shall be issued only to incorporated clubs which have been in existence for 3 years or more or to congressionally chartered veterans’ organizations which have been in existence for 3 years.
(2) This license shall be for the sale of intoxicating liquor to members and bona fide guests only. The license when issued under this division shall not count against the maximum number of on-sale licenses to be issued by the city.
(3) To qualify for a license under this division (E), each like club or veterans organization hereby agrees that only those guests shall be allowed in the club who are invited and accompanied by a member and that no employees of the club, whether members or not, consisting of bartenders, waitresses or managers can be the inviting member.
(F) Sunday on-sale licenses.
(1) Sunday on-sale licenses shall be issued only to restaurants, clubs and hotels and shall permit on-sale of liquor for consumption on the premises in conjunction with the sale of food between the hours of 12:00 p.m. on Sundays and 1:00 a.m. on Mondays.
(2) To qualify for a license a restaurant, club or hotel must have a seating capacity for at least 30 persons and hold an on-sale intoxicating liquor license permitting on-sale of liquor during lawful hours for the days Monday through Saturday.
