A. All prospective OMMA licensees shall submit a City Certificate of Compliance application and an OMMA Certificate of Compliance application to the City Clerk or his/her designee as required by applicable State statute and OMMA rules and regulations. The application shall be reviewed for compliance with the building and trades codes, health and fire safety codes, and zoning regulations of the City - including but not limited to inspections of the premises, buildings and processes engaged in by the business or facility in the cultivation, processing, dispensation or transportation of medical marijuana products licensed or otherwise regulated by OMMA.
B. Initial City and OMMA Certificates of Compliance shall be issued when designated officers of the City have approved the applications and have affixed their signatures to the necessary documents.
C. Any business or facility receiving an initial Certificate of Compliance on or after Oct. 1 of a given year shall be considered current with such through Dec. 31 of the following year.
D. On or about Oct. 1 of a given year, the City shall open the application process for renewal Certificates of Compliance effective on Jan. 1 of the following year. The renewal application shall be reviewed for compliance with building and trade codes, health and fire safety codes, and zoning regulations - including but not limited to inspections of the premises, buildings and processes engaged in by the business or facility in the cultivation, processing, dispensation or transportation of medical marijuana products licensed or otherwise regulated by OMMA. The renewal application shall include submittal of a valid OMMA license issued to the person, firm or corporation and specifying the business and/or facility location and activity.
E. The fees for initial and renewal Certificates of Compliance issued by the City for medical marijuana businesses or facilities shall be established by resolution of the City Council. (Ord. 2023-10, 9-12-2023)
