4-5-5: INVESTIGATION AND ISSUANCE OF LICENSE:
   A.   Police Report: Upon receipt of an application for license, the City Clerk shall refer one copy to the Chief of Police who shall note thereon any record concerning the applicant which may appear from the official records in his/her charge and return the same promptly to the Clerk.
   B.   Other Investigation Or Inquiry: The City Clerk shall cause such other investigation or inquiry to be made concerning the applicant as may be deemed necessary to determine the character and business responsibility of the applicant and whether his application is in compliance with the terms and conditions of this chapter. The Chief of Police shall report to the City Clerk all convictions for violations of this chapter and the Clerk shall maintain a record for each license issued and record the reports of violations therein.
   C.   Issuance Of License, Badge: If, as a result of the investigation, the character and business responsibility of the applicant are found to be satisfactory and the application is in compliance with the terms and conditions of this chapter, the City Clerk, upon payment of the prescribed license fee, shall issue the license. Upon issuance of the license, the City Clerk shall also issue and deliver to the applicant a badge in a size and of a nature to be designed by the Clerk which shall indicate that the applicant has received a license from the city.
   D.   Disapproval, Revocation, And Appeal: The City Clerk's office shall either give written notice by personal service or by mail to the applicant or licensee of a denial or revocation of the license. The notice, if mailed, shall be mailed to the address listed on the application. The license shall stand revoked or denied from the date the notice is delivered by personal service or received by the licensee by mail. The owner may appeal a denial or revocation to the City Manager within ten (10) days of the receipt of the notice by filing a written request with the City Clerk for a hearing. The hearing shall be conducted by the City Manager. The appealing licensee may be represented by counsel. The hearing shall be conducted in an informal manner, but no license shall be revoked or denied except upon a preponderance of the evidence. The City Manager may affirm, modify or vacate the order of revocation or suspension, and his/her decision shall be final. (Ord. 2019-07, 9-10-2019)
