9-5-4: REFUSE SERVICE CHARGES AND FEES; PAYMENT PROCEDURE:
   A.   Residential Refuse Service Charges:

Thereafter, the service charges/fees for all residential refuse service customers, whether residing within or without the city limits of the city of Skiatook, shall be increased by thirty five cents ($0.35), July 1 in each year beginning on July 1, 2017.
      2.   Senior Citizen Discount: There shall be a discount of two dollars ($2.00) per month for persons over the age of sixty five (65).
      3.   Compliance With Rules And Regulations: Residential refuse service shall be provided by the city in compliance with rules and regulations promulgated by the public works department.
      4.   Time For Placement Of Garbage For Pick Up: Residential refuse shall be placed at the appropriate approved pick up location prior to six o'clock (6:00) A.M. on the day of scheduled service.
      5.   Separate Dwelling Units; Multi-Family Dwelling Units:
         a.   Each dwelling unit shall be charged separately, and "dwelling unit", as used in this subsection, shall mean any structure, edifice, module, apartment or living area in which there resides or is intended to reside any person or persons, and shall include apartments, mobile home parks, trailers, residences, churches and any other places where persons may reside.
         b.   With respect to duplexes, triplexes, apartments and other multi-family dwelling units, each living unit contained therein shall constitute a separate dwelling unit.
         c.   Where dumpsters are approved for and provided to any multi-family dwelling development/complex or mobile home park, the service charge/fee for such shall be the same as that for commercial/industrial refuse service dumpsters.
      6.   Appropriation Of Revenues: Eight percent (8.00%) of the residential refuse service charges and fees collected shall be transferred to the city of Skiatook for use for property/nuisance abatement purposes within the community development budget for each fiscal year.
   B.   Commercial/Industrial Refuse Service Charges:
      1.   Rates Established By Resolution: Service charges/fees for commercial/industrial refuse services where provided by the city, both within and outside of the city limits, shall be established by resolution of the city council. Any established schedule of charges and/or fees may be amended by the city council, from time to time, at their discretion, and upon their sole determination that a change in such schedule of charges and/or fees, in whole or part, would be of benefit to the operations of the city.
         a.   City May Contract for Commercial/Industrial Refuse Service: The City, or the Skiatook Public Works Authority, if the Skiatook Public Works Authority is providing garbage and refuse collection services by agreement with the City, may contract with a suitable and capable person, corporation, limited liability company, or other entity for the collection, removal and disposal of commercial and industrial garbage, trash and refuse within the corporate limits of the City. Any contract entered into by the City or Skiatook Public Works Authority for commercial/industrial refuse service shall set forth the monthly service fees/refuse collection charges for each customer class as set by ordinance or resolution, the types of garbage containers to be furnished for customer use by the refuse service provider as required by ordinance, the amount of late payment fees, the frequency of the collection of garbage, trash and refuse, as well as customer billing procedures and procedures to resolve customer complaints and service issues. The City or the Skiatook Public Works Authority may either bill commercial/industrial refuse service customers directly, or a third-party commercial/industrial refuse service provider under contract with the City or the Skiatook Public Works Authority may bill customers directly, if so agreed between the City or the Skiatook Public Works Authority and the refuse service provider pursuant to contract. Any third-party refuse service provider shall be properly licensed and shall carry and maintain adequate commercial general liability insurance and workers' compensation insurance, as approved by the City Manager. All monies due to the Skiatook Public Works Authority shall be payable as set forth by agreement, and the third-party commercial/industrial refuse provider shall provide a written calculation of the fee paid, together with the total amount billed to commercial/industrial refuse collection fees and charges for the period as specified by agreement. In addition, any third-party commercial/industrial refuse provider shall be required provide a yearly audit prepared. by a certified public accountant evidencing the total amount billed for each fiscal year (July 1 - June 30 of following year) and the total amount paid to the City for that fiscal year.
      2.   Preparation Of Dry Refuse: When no dumpster is provided, where the volume of dry refuse generated by the commercial/industrial customer is less than three-fourths (3/4) cubic yard per day, refuse shall be placed in customer provided suitable tight containers having lids and no larger than thirty (30) gallons in size. Steel or metal barrels shall not be considered as suitable containers for placement of commercial/industrial refuse to be serviced by the city.
      3.   Term Defined: As used in this subsection, "commercial/industrial" shall mean any grocery store, retail store, wholesale establishment, nursing home, school, restaurant, cafeteria, automobile dealer, county and federal government building/office, motel, bar, lounge, service station, lumberyard, private utility company, doctor/dentist office, clothing store, furniture store, manufacturer, any location where food is sold for a charge, and any other business or establishment which is normally and commonly generally classified as a business or industrial use of property and not defined as a "dwelling unit" in subsection A of this section.
      4.   Additional Charge For Additional Pick Up: Commercial/industrial customers requiring a frequency of service greater than twice a week shall pay an additional service charge/fee per extra pick up required.
      5.   Dumpsters:
         a.   All dumpsters or polycart trash containers shall be furnished by the city, the Skiatook public works authority or a third party commercial/industrial refuse service provider under contract with the city or the Skiatook public works authority. Commercial/industrial customers shall be provided dumpsters or polycart trash containers of adequate size, as determined by the city, the Skiatook public works authority, or its/their third party refuse service provider, for twice a week service on dry refuse. Resizing and frequency of service shall be determined by the city, the Skiatook public works authority or third party commercial/industrial refuse service provider under contract with the city or Skiatook public works authority, according to usage.
Commercial/industrial customers where food or wet refuse is generated shall be serviced daily due to health considerations.
         b.   The city, the Skiatook public works authority, or a third party commercial/industrial refuse service provider under contract with the city or the Skiatook public works authority shall be responsible for, and perform, all maintenance on provided dumpsters and polycart trash containers. No dumpster provided by the city, the Skiatook public works authority or a third party commercial/industrial refuse service provider under contract with the city or the Skiatook public works authority is to be moved by the customer from the location where set by the city's sanitation department, the Skiatook public works authority, or a refuse service provider under contract with either the city or the Skiatook public works authority.
         c.   Dumpsters and polycart trash containers provided by the city, the Skiatook public works authority, or a commercial/industrial refuse service provider under contract are, when provided, and shall remain, the property of the city, the Skiatook public works authority, or such provider of refuse service, to be used only for their intended purpose at the location where placed by the city, the Skiatook public works authority, or a commercial/industrial service provider under contract with either the city or the Skiatook public works authority.
   C.   Responsibility For Charges; Prohibitions:
      1.   The person, firm or corporation responsible for payment of other utility service charges for any place or establishment shall be billed and be responsible for payment of all refuse service charges/fees to the premises whether such service be for residential or commercial/industrial trash service.
      2.   It shall be unlawful for any owner, occupant, tenant or lessee using or occupying a building, house, structure, apartment, dwelling unit or any place of business as a separate unit to utilize the garbage containers, cans or receptacles of another owner, occupant, tenant, lessee for the disposal of his garbage or refuse for the purpose of avoiding payment of fees levied by this chapter; and it shall not be a defense for any owner, occupant, tenant or lessee to refuse to comply with the provisions of this chapter on the grounds he or she uses a garbage disposal.
   D.   Billing; Delinquency In Payment: The billing rate and minimum apply only in case a bill is paid on or before the twentieth day of the billing. If not so paid, the gross rate, which is the net rate and minimum, plus ten percent (10%), then applies. This fee may be modified as necessary by resolution of the city council.
