8-1-8: RESTORATION OF STREETS:
 
   A.   Restoration By Applicant: Whenever an applicant shall, with or without a permit, disturb the surface of any street, alley, public highway, street maintenance easement, or ground for any purpose mentioned in this chapter, the applicant shall restore the same using "backfill" as defined in section 8-1-1 of this chapter, and when any opening is made by the applicant in any hard surface pavement in any street, alley, street maintenance easement, or public highway, the applicant shall promptly and properly refill the opening and restore the pavement.
 
   B.   Density Testing After Restoration: After restoration, the city shall conduct a density test. If the test reveals a proctor density of ninety five percent (95%) or more, the cost of the test will be paid by the city. If the test reveals a proctor density of less than ninety five percent (95%), the cost of the test will be borne by applicant; and, in that event, the applicant shall, at its expense, perform the backfill again until it meets this specification.
 
   C.   Restoration By City Upon Neglect By Applicant: The city may refill and/or repave in case of neglect by the applicant. The cost thereof, including the cost of inspection and supervision, shall be paid by the applicant. All excavations made by an applicant in the streets, alleys, street maintenance easement, and public highways shall be properly safeguarded for the prevention of accidents. The work hereby required shall be done in strict compliance with the rules, regulations, and ordinances of the city as now or hereafter provided. (Ord. 2000-10, 8-29-2000)
