The City of Skiatook, through its Fire Department/ambulance service/emergency medical service ("SFD" hereinafter), pursuant to 63 Oklahoma Statutes section 2515 is hereby established as the "sole source provider" for ambulance service transports originating within the Municipal limits of the City of Skiatook, Oklahoma. No other ambulances or ambulance services may respond to emergency medical calls originating within the City of Skiatook except upon mutual aid requests from SFD or with the consent of the City of Skiatook/SFD, or except as set forth in subsection A of this section.
A. Exceptions: No ambulance or ambulance service may transport patients to or from the Municipal limits of the City of Skiatook, Oklahoma, or otherwise respond to medical calls within the Municipal limits of the City of Skiatook, Oklahoma, except as provided by the following:
1. On a mutual or automatic aid request from SFD during such times as SFD cannot promptly and adequately respond to a request for emergency medical services;
2. By request of City of Skiatook/SFD or with the consent of the City of Skiatook/SFD;
3. Any ambulance owned or operated by, or under contract to perform ambulance transport services for, the Federal or State government, or any agency thereof;
4. Any ambulance owned and operated by a hospital and in use to transport a patient of the owner hospital, which patient has been admitted to and not been discharged from the owner hospital, to or from another hospital or medical care facility at which the patient receives a diagnostic or therapeutic procedure not available at the owner hospital;
5. Any ambulance engaged in a routine transport call to transport a patient from a hospital, nursing home, or dialysis center located within the Municipal limits of the City of Skiatook to any location outside the Municipal limits of the City of Skiatook;
6. Any ambulance engaged in the transport of a patient from a location outside the Municipal limits of the City of Skiatook to a location inside the Municipal limits of the City of Skiatook;
7. Any ambulance engaged in the interstate transport of a patient.
B. Mutual Aid Agreements Not Affected: Mutual aid agreements between the City of Skiatook/SFD and surrounding ambulance services/emergency medical services are not affected by this section. (Ord. 2012-12, 10-30-2012)
