1-7-3: CLERK OF COURT:
   A.   Creation; Appointment: There is created and established in the town the position of clerk of municipal court, a part time position, and the duties of the clerk of municipal court shall be performed by the municipal court clerk, who shall be appointed by the mayor, with the consent of the council. Said appointment shall be for a term of two (2) years and shall be made in accordance with subsections 1-5-1B and C of this title. (Ord. 340, 9-18-2003)
   B.   Duties: The clerk of the municipal court shall exercise the powers conferred and perform the duties enjoined upon him by statute and the common law. In the performance of his duties, he shall be under the direction of the municipal court. (1993 Code § 2.16.100)
   C.   Qualifications: The clerk of the court shall be a qualified elector of the state and a high school graduate or equivalent thereof. (1993 Code § 2.16.110)
   D.   Bond Of Office: The clerk of municipal court shall give a bond to the town in the amount of ten thousand dollars ($10,000.00), for the performance of all his duties in accordance with law and the ordinances of the town, and he will turn over to the parties entitled thereto, or as may be prescribed by the ordinances of the town, all monies collected by virtue of his office of clerk of municipal court.    E.   Duty To Preserve Papers: The clerk shall file together and carefully preserve in his office all papers delivered to him for that purpose in every action or proceeding. He shall not permit papers to be taken from his office except to be used at a session of court or upon legal process, and he shall be liable upon his official bond to the party suffering injury on account of any violation.    F.   Endorsement Of Papers: The clerk shall endorse upon every paper filed with him the date of the filing thereof and upon every undertaking given under the same, the date of its return to his office. (1993 Code § 2.16.140)
   G.   Recordkeeping: The clerk of municipal court shall keep the journals, records, books and papers pertaining to the court and record its proceedings. (1993 Code § 2.16.150)
